Not good.

It's not even ok for LEO to have such permission. What the hell are they doing giving such permission to regulatory agencies?

Looks like the Dims put that in the existing bill.

I wonder if the POTUS will sign it?

Rune has come out with an easily used one-time pad system.
Given appropriate preparation, email (or other file exchanges) can be secure among select parties.

From the article

CNET obtained the revised draft from one of the people involved in the negotiations with Leahy. We'll publish it shortly.
I'd like to see that.

When I first read through this, I hoped that this proposal was in direct relation to monitoring and control systems that are in place today. For instance, the Sarbanes-Oxley Act and how that changed records retention and storage.

In the interest of preventing another Enron sized scandal, I could see how this might speed things up and streamline the regulatory agency's workflow. I'm not suggesting I agree with it. Perhaps the agencies feel that removing some red-tape could improve their SOP's.

However, I do not have any confidence at all that this is the only intention of the bill. It's like a crack in the driveway. At some point, it spreads and turns into a gaping hole.

It could be a run in laminated safety glass for all I care. My concern with any of this stuff is not the high intent (if such exists). My concern is with wanton lack of muzzle discipline based on the character of the person wielding it.

Some would say that hole appeared with the so-called Patriot Act...
