So found out my wife is married in another country...

I did some research on this topic but could not really find a good answer and my recruiters are not available (nor do they know I'm sure).

Background: My wife had a previous marriage in Mexico, and she supposedly got divorced in Mexico several years ago. I guess the way they have it set up down there is the state your born in is where you have to file the divorce, and then that gets transferred to the state you were married in and a judge there has to sign it. Then, and ONLY THEN, is one legally divorced. Seems rather stupid to me.

I just found out yesterday that, as my wife DID get the process started and everything taken care of in Coahuila (the state she was born in) it did NOT get approved by a judge in Juarez, where she was married.

This technically makes our marriage in the states invalid and she does NOT want to get remarried to me. Sucks, right?

I am pretty sure this will nullify all the crap that we had to go through to get her social security number and permanent residency and everything and will look as if she deceived me into getting married to get it. Which is kinda how I feel right now.

The problem is we have a child together. Does the fact that it is now possible for her to get deported make it so I can no longer go into the army after all? The problem would be, if she is deported, what happens to my child while I am in training or whatever and unable to attend to him?

I am already set up with an 18x contract and set to leave early May. I don't know if this totally shafts me though.

Any links or references would be appreciated, as I could not find any.

More than a few questions

You have more than a few questions.

The first from me is "Are you a couple, man & wife or is she splitting anyway?"

The second is "Did she deceive you or was it a mistake?"

If you're splitting anyway do you get custody of the child? If so you'll be a single parent - and that will cause problems with your dreams. Kids kinda' tend to do that - just have to change your dreams.

You need to see a lawyer - but I think most case law is on your side - not her's.

That's kinda what I figured I would have to do.

No we are a couple. I want to stay together, but she is saying now she wants nothing to do with the army or that kinda life and she just 'made a mistake when she married me'. Ok fine. Kind of an unresolvable discrepancies issue.

What I would like to happen is that, even if she doesn't want to stay with me anymore, that she can keep her residency and stay in the states. I guess your right this is a very complicated question and would need to see probably a divorce lawyer and an immigration lawyer. Again. Ugh..

Well this just came to mind: while talking to my recruiter a while back, he said that alot of soldiers get married to girls they meet in Japan or Germany, and then bring them back to the states. Now I am sure that not all of them stay married and that there are are a few that only get married to 'get papers' and come to the US.

Do any of you know or have heard of women getting deported back to their home country after they get divorced?

Wife or no wife a child is forever and if that child is under the age of 18 then that child is your responsibility, period.

If you're going to join the army to run away you might want to rethink your MOS choice, we don't quit and we would never quit on our children.

Sad story or not that child comes first. Man up and do the right thing.
