Appears as if some deputies may be ignoring their oath.

Injured veteran arrested in weapons investigation

A former Fort Drum soldier who was injured in special forces training was arrested Sunday night when he was found with prohibited rounds of ammunition, the Jefferson County Sheriff’s Department said.
Nathan H. Haddad, 32, of 25240 Waddingham Road, town of LeRay, faces five felony counts of third-degree criminal possession of a weapon. He was released without bail before town of Watertown Justice Andrew N. Capone, and is ordered to appear Wednesday in town of LeRay Court.
Deputies made the arrest shortly before 7:30 p.m. Sunday on Steinhilber Road in the town of LeRay, where Mr. Haddad is accused of possessing five 30-round AR-15 magazines of ammunition. He is cited under a state penal law statute that prohibits possession of “a large capacity ammunition feeding device.” The ammunition was found in his vehicle during a traffic stop, according to the sheriff’s office.
Mr. Haddad was deployed four times during his decade in the Army, the Times reported in a story featuring him in September 2009. At that time, he was a staff sergeant with the 3rd Battalion, 85th Infantry, Warrior in Transition Unit at Fort Drum, undergoing aquatic physical therapy for an injury he suffered in South Korea during special forces training. He was discharged from the Army in October 2010, according to Fort Drum.

And unless they fixed the law - those deputies were just as guilty of that state law when they took possession of those "illegal" feeding devices.

So any soldier Leaving the gates of Fort Drum that happens to have a M9 magazine or a 30 round mag will be arrested?
It seems crazy, but that’s what I get out of this law. What about small combat teams that deploy with maybe five guys and keep their weapons and mags in a pelican case on the way to the airport? Under current law the whole team goes to jail?
I have to wonder too, with the ONE identifying feature of the "pistol grip" makes it a "assault weapon". So is that to say that ANY hand gun, or rather ANY semi-auto hand gun is an illegal assault weapon?
How does this law apply to police? I think the way the law stands now they have to comply to this as well.

Pulled over for a traffic violation that ended in a car search? It would seem they were in plain sight or this guy didn't know his rights against illegal search and seizure.
The NY state law reads that it is a class A misdemeanor for the mags not a felony and doesn't go into effect until March of this year. Unless I read it wrong.
Was he even a soldier...(or just a former soldier) The article was poorly researched and poorly written, but then, what do we expect from our nations journalists?

This is so true. It is difficult to know what the facts actually consist of from this article.
Some food for thought, I believe that prior to NY's most recent 2013 gun control legislation...30 round magazines may have already been banned by previous NY AWB legislation. The new legislation just goes further. If so, he was probably arrested based on the old law not the new.
ETA a link below to what purports to be a legal defense fund - perhaps a place to ask questions - get straight answers and help. I just found this and never know the legitimacy of these things. But, I do know that NY folks will probably need various types of support and help.

You are correct. NYS passed an AWB 2.0 in 2000[1]. They took much of the regulation from the Federal bill, including the 10rd mag limit.

The good folks of NYS may soon be a Petri dish for gun rights. It appears that perhaps the NYS gun lobby and NYS firearms supporters were a bit late to the last dance (based on the speed with which the SAFE act was passed). To be sure, gun owners in NYS might have been victims of what might be referred to as a "perfect storm."
Vigilance is paramount.

MOO: I think the taxes are more acute at the moment than gun rights, and people[1] and businesses[2] are voting with their feet. Personally, I am done with NY, and in the process of leaving, August can't come soon enough
