The Executive Branch

Thoughts that have been rolling around in my head the last few days, as to why the Dems think that Obama interloping into people's every day affairs is a good thing. It seems he has taken the advice of those like Maxine Waters and decided to make new laws via "Executive Order". So we have the contraception mandate, we have the school lunch debate, we have Czars that answer to no one but the POTUS. we have recess appointment while Congress isn't in recess, etc etc etc...

Rougish Lawyer, correct me if I am wrong, but doesn't presedent play a large role in determining the constitutionality of a law?

So my thought/question is: Are they so short sighted as to think a Republican is never going to win the Presidency again, and thereby being able to use the presedent set by Obama to do whatever he/she likes when he/she likes? Because you can bet if a Republican POTUS was doing this crap the Dems would be up in arms.

That is how I have started addressing my arguments to friends who are left leaning "If George Bush was doing such things, how would you feel?" And they usually come out with "That wouldn't be right". So if it is ok for the current POTUS, why not a Republican one?

When the Republicans held both chambers of Congress, as well as the White House, the Dems would go on and on about how Congress is abdicating their responsibility in checks and balances, and allowing Bush to do whatever he wanted. Now they are guilty of the same thing. Why don't our Congress critters take their job of checks and balances more seriously, regardless of what party they belong?

I think if the Rebulican candidates can start making that argument against Obama, instead of arguing amongst themselves, we would have a much bigger chance of taking over the White House as well as the Senate.

The best line I have read lately was on a blog on NR. It said if Democrats are scared of Santorum and his social conservatism, they should be really scared of Obamacare and the precedent it has set for all future Presidents.

Executive Orders have been used by President's since 1789 - the vague Constitutional justification for them under Article II and the history of their use makes for some interesting reading.

The so-called Czars have been around since the New Deal - FDR had 11, HST had 6, DDE had 1, LBJ had 3, RMN had 3, GRF had 2, JEC had 2, RWR had 1, GHWB had 2, WJC had 8, GWB had 33 and now BHO has 38.

Presidents seeking "out of session" or "midnight" appointments to counter a politically recalcitrant Congress have been around since John Adams.

It's politics and a conundrum long overdue for a solution...or maybe not.

And so it goes...

Don't worry.

The MSM will wake the people up as soon as a Republican is elected President.

And that will be a long day comin' if the Press has anything to do with it. Oh, wait.....

This is why there were to be Three Branches of Government. They were supposed to guard fericely their branch against abusive precedent from either the of the others.

The Senate should have already Sued POTUS for that "recess appointment".
The Congress should have already started Impeachment proceedings for the Director of HHS.
Plenty more could be cited, tho these are the most current.

Congress should call a time-out, pull out the rule book and jam it down their YOB

I agree with you. Congress critters from both Partys have failed to voters. They have bent over and asked the Exeutive branch to give it to them. Why? I think because they are cowards that do not want to take responsibility or blame for anything that happens and are willing to trade the well being of the nation inorder to get re-elected. Most if the issues we face today can be laid at the feet of Congress. The Congress and the Senate seats that are in play in this next election are as important as who will serve as President. not more important but just as important. One of the most serious things the president will do in the next 4 years will be to decide who will serve in the Federal courts and the Supreme Court. I am hopeful but not optmistic.
