Reservist sues to avoid recall

Wondering what some of the other opinions are on this. I would have to say that mine would be ignorance of the regulations is not an excuse to avoid the recall. He failed to properly resign his commission then he is fully eligible to be recalled.

The regs are clear. He needs to send in the statement resigning his commission.

He has the right lawyer, though.

Concur with TR. When I went IRR, I knew that I was basically in for life unless I resigned my commission.

As an aside, no involuntary recall for me so far. I guess 2LT's without an OBC aren't needed.

POS spent 4 years on AD and did't make O-3!!! Would you want him in your unit??

I agree with BMT - this guy has "shitbag" written all over him. He would be a hindrance to any unit that he might end up in. Odds are his former commanders were glad to see him leave.

He should be made to pay back his scholarship, and any pay he has ever recieved from the Army - as he was most likely a thief of government time and resources from the beginning.

My take is that the man pissed someone off in personnel. Rather than ask for a hearing he said something to the efect that: "Tou can't do that!" and the army chose to prosecute the letter of the law. I have seen many people self-destruct when a cooler, calmer reaction could have avoided the problem.

Knowing that ignorance is no excuse we need to remember a primary precept of the army: "A lieutenant is presumed ignorant until proven otherwise."

If I remember correctly, it is until a certain age (50?), but otherwise, I agree. Moron should have known. I damn well know that every member of my IOBC class knew, and the class before and the class after. Maybe he just slept through his basic course.

Oxygen thief, f-ck him. He can resign if he doesn't want to be in anymore. But then I guess he couldn't put it on his resume or brag about it to anyone within hearing that he was an officer.

Probably still a POS but it is or was possible to enlist and go to OCS later. I don't see anywhere that he spent 4 years on AD as an officer. It wasn't uncommon for an RO to get out as a 1Lt.

The article states that he received an ROTC Scholarship in 1992. He likely graduated and received his commission in the fall of 1995, since it says his 8 year commitment ended in Dec of 2003.
