Because hate crimes tend to be defined using protected classes similar to those in anti-discrimination statutes (race, gender, etc.). Like anti-discrimination statutes, they tend to be enforced only to benefit those viewed by the Left as historically victimized and therefore worthy of additional protection.
Whether this murder should be a hate crime, or whether there should be such a thing as a hate crime, are separate questions.
The DA just let this guy out on a very low bail. I also suspect the DA will try to let him walk with some very diminished plea deal.

Speculation: There are a couple of remarks that may imply that the kid's family and Brandt have prior knowledge of each other. Maybe a feud?
The Kid's family should be hunting for the best ambulance chaser for a post-plea deal battle..
