I heard this on the Schnitt Show and got the URL from his website. Is this just a convenient excuse to not deploy or a valid objection?

UPDATE: The Army has revoked the deployment orders for a soldier who said he shouldn't have to go to Afghanistan because (he believes) Barack Obama was never eligible to be president.
Because he's a reserve soldier who volunteered for an active duty tour he can "ask for a revocation of orders up until the day he is scheduled to report for active duty," a public affairs officer explained. Cook volunteered for the tour in May of this year. It is not clear why he did so, considering his current objections.

Obama birth certificate deniers won a small victory in court on Monday. Meanwhile, one such conspiracy theorist refused to deploy to Afghanistan on the grounds that Barack Obama isn't a legitimate president.
A judge said he would listen to "the merits" of Alan Keyes' case challenging Obama's presidency. While a spokesman for the U.S. Attorney's Office said the move was merely procedural, birth conspiracy proponents are encouraged:
Supporters of a case that disputes the legitimacy of Barack Obama's presidency claimed a small victory today when U.S. District Judge David O. Carter told them to fix their paperwork and that he would listen to "the merits" of their case. But others present for the hearing Monday at the federal courthouse in Santa Ana stressed that the case remains a long way from ever getting a full airing in court and may never get to that point. Perhaps because of that history, Orly Taitz, the lawyer who filed the current suit, was greatly cheered by Monday's hearing. "He's very determined to hear the case on the merits," Taitz said, referring to the judge. "He stated, the country needs to know if Mr. Obama is legitimate, if he can legitimately stay in the White House."
Orly Taitz, the lawyer in Keyes' case, is also representing a soldier who refuses to acknowledge Obama as his president. U.S. Army Maj. Stefan Frederick Cook has argued that he shouldn't have to go to Afghanistan because the man sending him there isn't really president.
In the 20-page document -- filed July 8 with the U.S. District Court for the Middle District of Georgia -- the California-based Taitz asks the court to consider granting his client's request based upon Cook's belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.
Cook further states he "would be acting in violation of international law by engaging in military actions outside the United States under this President's command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties."
A hearing to discuss Cook's requests will take place in federal court this week.

While I agree the Major is not the brightest bulb in the pack, the legal argument he makes is in fact valid. Our authority to function as a military comes from the Office of The President. If the President is not constitutionally qualified to hold office, are his orders valid? This issue has NEVER been addressed by the courts.
Here’s what I think is happening here.
In order to bring this case to court, the plaintiff must have what is known as status (standing) to sue. For example, if you remember the guy who took the pledge of alliance case to the Supreme Court on behalf of his daughter? He lost because the Supreme Court said he didn’t have status (standing) to sue thus avoiding the real issue presented before the Court.

Most of the cases that have been brought challenging the citizenship of the President have likewise have been dismissed because the judge found that the plaintiff didn’t have status to sue.
This case is using the Major to try to make sure that the case gets heard on its merits and not on the issue if the plaintiff has standing to sue.
There have been over 30 cases thus far in various courts challenging the citizenship of the President Obama. President Obama’s purported ‘Certification of Live Birth’ that was posted on his campaign website has NEVER been submitted in hard copy to ANY of the cases thus far as evidence of his birth. It ONLY exists as a web image. I find that very strange.

One wonders that if this is a valid copy of President Obama’s birth certificate, why haven’t his lawyers simply presented it to the courts and then ask for a summary dismissal of the case? Instead they have been fighting tooth and nail over procedural issues to avoid dealing with the merits of the case.
At some point a judge will order the President to produce his birth certificate. Then the battle will go to the Supreme Court for a decision.
If the Major wins his case, he will be in the history books forever. If he doesn’t then he can kiss his career goodbye and he will fade away into obscurity. I would not make this bet but to each his own. Consiglieres, feel free to show me where I’ve gone wrong here!

Fact or Fiction it is a waste of time. If it true that O is not a citizen I highly doubt anyone is willing to pull the trigger on it for fear of violence.
It is too simple for O to put it to this rest, and anyone that would spend millions of dollars on a team of lawyers to prevent disclosure probably has something to hide.

The Air Force One, carrying the 44th American President, his wife, Michelle and two daughters, as well as a retinue of senior US government officials, is expected to touch down at the Kotoka International Airport at 8:30p.m. tomorrow amid tight security by US and Ghanaian security agents.
A red carpet reception, spiced with rich Ghanaian cultural performance, awaits Mr Obama and his entourage at the Jubilee Lounge of the airport and that warm embrace will give him a foretaste of the proverbial Ghanaian hospitality that he will be served with during the period of his visit.
A host of White House correspondents and international journalists are expected to accompany the world’s most powerful personality; an ample signal that Ghana will come under global spotlight for the period of his stay in the country.
Ghana expects to take full advantage of the huge international exposure to boost its image, investment drive and tourist attractions, and rightly so, as the Foreign Minister has called on the international business community to take advantage of opportunities in the country to locate here.
Ahead of the visit, the National Security Council is co-ordinating a contingency security plan involving the various security agencies, but with the police as the key actors, to ensure success.
The Public Affairs Director of the Ghana Police Service, DSP Kwesi Ofori, said the contingency plan involved traffic control, road blocks at short notice, increased police patrols and a full presence of the police at vantage locations.
In line with the security measures, people carrying bags and unwarranted objects are forbidden from going near venues where Obama would be visiting, while indiscriminate motorbike riding and indiscipline by motorists on the roads would not be tolerated.
The recent exercise to clear the central business district and other parts of Accra of street hawkers and traders gives a vivid posture of official intolerance to general indiscipline before and during the visit of Mr Obama.
DSP Ofori appealed to motorists and the general public to cooperate with the security agencies to ensure the success of the visit.
The Ghana trip is the final leg of a three-nation tour by the US President, having breezed through Russia and Italy, where he attended the G8 Summit.
This will be the third time a sitting American President is visiting Ghana, after two similar visits by President William Jefferson Clinton in March 1998 and President George Walker Bush Jnr in February 2008.
The eight-hour visit by Clinton was the shortest, but by no means very significant, given the fact that he was the first sitting US President to step foot in Ghana, and as he later indicated, it was the most memorable foreign trip he ever made as President.
With two nights sleep and 36 hours stay in Ghana, President Bush’s visit glows into huge significance as the longest of the three visits.
Spending one night and about 24 hours in Ghana, Mr Obama will not be spending as much time in the country as Bush did; he is also not the first of the three to visit, but undoubtedly, the significance and historic nature of his visit will dwarf those of Clinton and Bush.
Prior to the announcement of the Ghana trip, it was widely speculated that Mr Obama’s first visit to Africa will be to Kenya, the land of his paternal ancestors.
However, Ghana’s political pedigree as the first independent country in sub-Saharan Africa and kingpin of Africa’s liberation struggle, as well as its recent exemplary strides in democracy, political stability and good governance, might have been compelling credentials that made it a preferred destination for Mr Obama, instead of his own fatherland.
That judgement by the White House will surely be greeted with tumultuous cheers by millions of Ghanaians on the streets of Accra and Cape Coast for a man they have so much affection for, even from the farthest distance.
Already, the anticipated euphoria is gaining great momentum with high patronage of Obama-branded clothes, T-shirts, various paraphernalia and even biscuits.
Mr Obama’s expected visit to the Cape Coast Castle will enable him have a sense of the symbolic ties between Africa and Africans in the Diaspora; a relationship that is expected to present an emotional memory of the slave trade.
Tentatively, the iterinary of the American President, according to information from the Foreign Ministry, includes a visit to a health facility at La and an interaction with Parliament.
According to the White House, while in Ghana, Mr Obama would look forward to strengthening the US-Ghana relations and highlight the critical role that sound governance and civil society play in promoting sustainable development.
Coming at a time when the world economy is going through a downturn, President J. E. A. Mills and his guest are expected to hold bilateral talks on a wide range of issues, particularly the economies of the two countries.
Other issues likely to engage their attention include the review of existing US programmes in Ghana, such as the Africa Growth and Opportunity Act (AGOA), which allows Ghanaian businesses to export about 6,400 duty-free and quota-free commodities to the US market; the Millennium Challenge Account (MCA), and the Africa Financial Sector Initiative, which allows Ghana to access facilities at the US Exim Bank and the Overseas Private Investment Corporation (OPIC).
Others are the President’s Malaria Initiative, the President’s Emergency Plan for AIDS Relief (PEPFAR) and the African Growth Competitiveness Initiative aimed at supporting capacity development in international trade.
“The visit will afford us the opportunity to exchange views and explore ways of further strengthening cooperation in the areas of agriculture, health, education, infrastructure development, trade and investment for the mutual benefit of both countries,” Alhaji Mumuni indicated.
It is the expectation of Ghana’s Foreign Minister that President Obama would continue with the positive programmes initiated by his predecessor “in order to put Africa on the path of accelerated development”.
On the flip side, however, the discovery of oil by Ghana will be an interesting subject for Mr Obama, considering the large quantity of oil America imports from the Gulf of Guinea.
The two leaders are also expected to discuss threats posed to Ghana’s security by the activities of drug traffickers and measures to control them, as well as issues relating to peace and stability in Africa, particularly Darfur, Guinea Bissau, Cote d’Ivoire and Guinea.
There are speculations that President Obama might push for the establishment of a United States Africa Command (AFRICOM) in Ghana after his predecessor had failed to do so, but the Foreign Minister said such a proposal had not been put before the government.
“Should this happen, the government will take a decision based on the supreme interest of the nation,” he remarked.
At the end of his visit to Ghana in 2008, President Bush announced a $17 million package for Ghana to fight malaria and also left behind a terminology that fascinated many Ghanaians for many days afterwards.
At a joint press conference with former President Kufuor at the Castle, Osu, President Bush denied rumours that the US wanted to establish a military base in Ghana and to make himself clear, he said “That’s baloney; or as we say in Texas, that’s bull”.
As President Obama makes his historic visit to Ghana, the question on the lips and minds of many Ghanaians is “What is he bringing to or leaving with Ghana?”

Two, he and his supporters realize that the issue is a nice tar pit into which pachyderms can be lured. Challenges to his citizenship cost time, money, and, most importantly, political capital.
In the unlikely event that it seems he'll be required to prove his citizenship, he'll do so at the next to last moment. His challengers will lose credibility for making much ado about nothing while his supporters will Costanza and say "Told ya so!"
Obee's mother was a US citizen - he could hold dual citizenship until 18 - at 18 he had to choose - he obviously chose to be a US citizen - nothing naturalized about it at all - saw it happen to a lot of dependent children who had one parent a US citizen and one who wasn't.

I have to wonder if there is a truth here? What ever is presented, and how it is presented, claims of treachery, treason, and trickery will abound ( 3"t's", I did it again didn't I ). We may never know the truth. Perhaps the POTUS himself does not know the truth.

The Major's deployment orders were not issued by the President. It makes no difference if the CINC is found to be a non-citizen or a Wombat.
Using Major Moron's logic all troops in the military could simply refuse to do anything based on their belief that the POTUS is not eligible to hold office. The validity of the guy in the Oval Office does not affect the validity of orders issued by DOA.
Ridiculous.
The Major's issues aside, I read an article pre-election which explained that during the time Obama was in High School in the Pacific, the country and schools required that all students be a citizen of that country. Also at the time the US did not recognize that country's citizenship for dual citizenship and as such, Obama would have renounced his US citizenship in order to attend school as a citizen of that country. For the life of me I can't remember which country it was but I'll look into it. I have always thought according to these circumstances he wouldn't be eligible for the Presidency. Or I could be in left field somewhere...

Retired general, lieutenant colonel join reservist’s lawsuit over Obama's birth status
A controversial suit brought by a U.S. Army reservist has been joined by a retired Army two-star general and an active reserve Air Force lieutenant colonel.
Maj. Stefan Frederick Cook filed the suit July 8 in federal court here asking for conscientious objector status and a preliminary injunction based upon his belief that Barack Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.
But before the issue got to court, Cook’s orders to deploy to Afghanistan were revoked. Lt. Col. Maria Quon, U.S. Army Public Affairs Officer, U.S. Army Human Resources Command-St. Louis, said Tuesday that Cook was no longer expected to report Wednesday to MacDill Air Force Base in Florida for mobilization to active duty. Cook, who claims he is now the victim of retaliation due to his suit, received his mobilization orders to report for active duty at MacDill on July 15. From there he was to go to Fort Benning, on July 18, for deployment to Afghanistan.
Cook is an Individual Mobilization Augmentee (IMA). This means he’s a reserve soldier assigned to an active component unit consisting of active duty soldiers instead of a reserve unit, which is composed entirely of reserve soldiers. He is assigned to the U.S. Army Element of U.S. Southern Command.
Last week Cook filed a request in federal court seeking a temporary restraining order and status as a conscientious objector represented by California attorney Orly Taitz.
The government, in its response to the suit, claims that Cook’s suit is “moot” in that he has already been told he doesn’t have to go to Afghanistan, so the relief he is seeking has already been granted.
“The Commanding General of SOCCENT (U.S. Special Operations Central Command) has determined that he does not want the services of Major Cook, and has revoked his deployment orders,” the response states.
Taitz argues in a pleading revised following the revocation of Cook’s orders, that the application for preliminary injunction is not moot and that retired Maj. Gen. Carol Dean Childers and U.S. Air Force Active Reservist Lt. Col. David Earl Graeff have joined the suit “because it is a matter of unparalleled public interest and importance and because it is clearly a matter arising from issues of a recurring nature that will escape review unless the Court exercises its discretionary jurisdiction.”
Cook’s resubmitted Application for Preliminary Injuction is meant to encompass the possibility of Cook receiving future orders for deployment as well as to address and prevent “negative collateral consequences such as retaliation against Major Stefan Frederick Cook ...”
As to the retaliation issue, the revised suit states Cook lost his job at Simtech, Inc., a corporation that does Department of Defense contracting in the field of information technology/systems integration, because of the suit and has additionally been subjected to “gossip” from people who believed Cook was “manipulating his deployment orders to create a platform for political purposes.”
Taitz, who has also challenged the legitimacy of Barack Obama’s presidency in other courts, filed the original suit with the U.S. District Court for the Middle District of Georgia.
In the filing, Cook states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. ... simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

Purely MOO...but...this is a pure waste of time. Even if it was proved that the POTUS was actually a gray alien from Sirius-6 ( :rolleyes: ), the Supreme Court would (again, IMO) find a way to rule that the results of the election were constitutional and he was POTUS.
What his opponents need is patience. If he guides the nation successfully through the various challenges we face, nothing - absolutely nothing - will suffice to discredit him. Arguably, he will have earned the adulation he will receive in that case.
However, I suspect the challenges are such that neither he nor anyone else can navigate them with full success. Then, his clear and documented performance will persuade the electorate. He will become unpopular, the voters will curse his name, and he will leave office looking a great deal older.
I believe some of the martial arts urge the use of the opponents momentum against them. That seems like a good approach here too.

A great many supporters of each party love these arguments - they create fire and passion, and permit dark suggestions of the most evil conspiracies. Which is great for raising money or motivating campaign workers. Discussions of nuances of policy seldom get the blood pumping as well as do accusations of stolen offices. From his perspective, it keeps his opposition busy doing useless things.
If people really dislike his policies, a congressional election occurs in something like 16 months. I suspect the Democrats will lose the House due continued high unemployment. Then there will be gridlock for another two years (not that that's a bad thing...). After that, who knows?
But the birth certificate thing? It might have been a worthwhile attack a year ago. Presently, it doesn't matter - except for its entertainment value.

Well, there is an IMAGE of it on the webb. Funny that in over 30 court cases, no HARD copy of it has ever been presented to a court as evidence of his Hawaiian birth.
If the web image is the real thing, why hasn't it been presented to a court as evidence?

Doesn't matter if Obama's mother was a US citizen. The question is can she pass citizenship to Obama?
If the birth took place outside of the USA, she can't.
For his mother to pass citizenship to Obama when his father was not a US citizen she had to have lived in the USA for 5 years past her 16th birthday at the time of the birth, IF THE BIRTH TOOK PLACE OUTSIDE OF THE USA. She gave birth when she was 18. Thus if Obama was born in Kenya his mother COULD NOT have passed citizenship to him as she hadn't lived in the USA for 5 years past her 16th birthday. Thus the ONLY citizenship he would have would be that of his father's.
If the birth took place IN the USA she can pass citizenship to him no matter how long she had lived in the USA past her 16th birthday.
That is why there is such a fight about WHERE the birth took place.

While I've little interest in getting in the middle of the Obama birth
issue, Paul Hollrah over at FSM did so yesterday and believes the issue can be resolved by Obama answering one simple question:
What passport did he use when he was shuttling between
New York , Jakarta , and Karachi ?
So how did a young man who arrived in New York in early June 1981,
without the price of a hotel room in his pocket, suddenly come up with the price of a round-the-world trip just a month later?

The American people not only deserve to have answers to these questions,
they must have answers.
It makes the debate over Obama's citizenship a rather short and simple one.
Q: Did he travel to Pakistan in 1981, at age 20?
A : Yes, by his own admission.
Q: What passport did he travel under?
A: There are only three possibilities.
1) He traveled with a U.S. Passport,
2) He traveled with a British passport, or
3) He traveled with an Indonesia passport.
Q: Is it possible that Obama traveled with a U.S. Passport in 1981?
A: No. It is not possible.
Pakistan was on the U.S. State Department's "no travel" list in
1981.
Conclusion:
When Obama went to Pakistan in 1981 he was traveling either with a
British passport or an Indonesian passport.
If he were traveling with a British passport that would provide proof
that he was born in Kenya on August 4, 1961, not in Hawaii as he claims.
And if he were traveling with an Indonesian passport that would tend to
prove that he relinquished whatever previous citizenship he held, British or
American, prior to being adopted by his Indonesian step-father in 1967.
Whatever the truth of the matter,the American people need to know how he managed to become a "natural born" American citizen between 1981 and 2008..
Given the destructive nature of his plans for America ,
as illustrated by his speech before Congress
and the disastrous spending plan he has presented to Congress,
the sooner we learn the truth of all this, the better.
If you Don't care that Your President is not a natural born Citizen and in Violation of the Constitution, then Delete this and go into your cocoon.

1. He could have also held a Kenyan passport (Kenya became independant in 1963).
2. That fact that the State Departmant said no to travel to Pakistan in 1981 doesn't mean that the Pakistani immigration officers would not have let him into Pakistan on a US passport. They very well may have let him in on a US pastport. The issue would have been, what would the US immigration officers have done when he RETURNED to the USA with a Pakistani visa stamp on his US passport?
One of my best friends was at the embassy in Pakistan in 1981 - he later earned a Blue Star when the embassy was overrun a few years later - if he ran for POTUS would someone on the WWW accuse him of having an invalid passport or defying the recommended travel restrictions, too? :confused:

Army Captain Files Suit Over Obama’s Citizenship Status
Connie Rhodes says she or others shouldn't have to go to war until Obama's legitimacy is proven

An Army captain fighting deployment to Afghanistan has challenged the legitimacy of Barack Obama’s presidency in a federal complaint filed this month, and has employed attorney Orly Taitz — a national figure in the “birther” movement — to represent her.
The complaint of Capt. Connie Rhodes, filed Friday in the Columbus division of U.S. District Court, is similar to the July 8 suit filed by Maj. Stefan Frederick Cook, who sought conscientious objector status and a temporary injunction. Taitz represents both.
Judge Clay Land, who will hear Rhodes’ case, tossed out Cook’s case in July. Land said the judicial branch shouldn’t inject itself into “political disputes” and shouldn’t get involved in hypothetical debates that haven’t yet become actual legal disputes.
The Rhodes complaint makes similar arguments.
“Plaintiff ... submits and charges that the current de facto president is an illegal usurper, an unlawful pretender, an unqualified imposter ...” the complaint states. “(She) submits that she cannot lawfully act under his authority, but that she is being forced to do so without any opportunity or remedial avenue whatsoever.”
Rhodes seeks to stop U.S. Defense Secretary Robert Gates, the commander of Fort Benning and others from giving any order to her or others until Obama’s legitimacy is established, the complaint states. She also seeks conscientious objector status based on her doubts of Obama’s constitutional qualifications.
A hearing on Rhodes’ complaint hasn’t been scheduled

Birther Orly Taitz's Lawsuit Dismissed

A U.S. district court judge on Thursday dismissed a lawsuit involving Orly Taitz seeking to have President Obama removed from office because he is not a natural born citizen of the United States.
In his dismissal – which is, despite the legalese, a pretty entertaining read – Judge David O. Carter writes that removal of a sitting president for any reason "is within the province of Congress, not the courts."
"Plaintiffs have attacked the judiciary, including every prior court that has dismissed their claim, as unpatriotic and even treasonous for refusing to grant their requests and for adhering to the terms of the Constitution which set forth its jurisdiction," he writes.
"Respecting the constitutional role and jurisdiction of this Court is not unpatriotic," continues Carter. "Quite the contrary, this Court considers commitment to that constitutional role to be the ultimate reflection of patriotism."
Carter says at another point that "the hearings have been interesting to say the least."
"Plaintiffs’ counsel has favored rhetoric seeking to arouse the emotions and prejudices of her followers rather than the language of a lawyer seeking to present arguments through cogent legal reasoning," he writes. "While the Court has no desire to chill Plaintiffs’ enthusiastic presentation, Taitz’s argument often hampered the efforts of her cocounsel Gary Kreep (“Kreep”), counsel for Plaintiffs Drake and Robinson, to bring serious issues before the Court."
"[T]he Court has received several sworn affidavits that Taitz asked potential witnesses that she planned to call before this Court to perjure themselves," writes Carter. "This Court is deeply concerned that Taitz may have suborned perjury through witnesses she intended to bring before this Court."
Elsewhere in the document, Carter says that "[p]laintiffs appear to assume that should the Court receive a document from Kenya, the Court would give credence to this document over the American birth records of the President and the case would be resolved."
"Even should the Court permit the issuance of a letter rogatory to Kenya, the Court would still engage in a comparative exercise in which the records of America, which has historically maintained some of the most credible recordkeeping practices in the world, would be contrasted with the credibility of the records obtained from Kenya," he writes.
The Judge complains that the plaintiffs "have encouraged the Court to ignore these mandates of the Constitution; to disregard the limits on its power put in place by the Constitution; and to effectively overthrow a sitting president who was popularly elected."
At one point, in a footnote, Carter says that "The inclusion of the First Lady in this lawsuit, considering she holds no constitutional office, is baffling."
Taitz has filed multiple court cases making similar claims, and was fined $20,000 following another dismissal by a judge who says she had abused "her privilege to practice law." She is refusing to pay the fine.
