NY Court Orders non-Vax'd Reinstated

Fired NYC employees, many of which were Fire Fighters and Police, are to be reinstated with back pay. The ruling judge let it fly pretty good.

Link to the 13 page PDF ruling. Pretty good read. Fired under De Blasio, and current Mayor Adams had vowed they'd not be rehired.

Notably also the judge ruled that the petitioners' equal protection rights as well as substantive due-process rights were violated under sections specified of the NY Constitution.

IANAL, but does this last mean they also have a further avenue for civil action against NYC?

I wonder if service members that have faced adverse actions will have any recourse...

probably not - but who knows

That was the real reason this ruling grabbed my eye. If it holds in the face of a near-certain NYC appeal, I don't know how the wrong that has been done to our service members, and our readiness as a whole, can be ignored any further. The clear intent to File-13 anyone's exemption request is even more glaring than the NYC situation.
We shall see. It needs a hearing at any rate.

well, its not like it really matters - according to policy decisions from the POTUS and SecDef after first taking office, you could deduce that most of the military is made up of racists, bigots, misogynists, and extremists - so they probably got what they deserved

get the jab, eat your peas

I hope so, but don't think so

The NYSSC decision cited "compliance, not health safety" as one reason for the decision, but the military is all about compliance. As long as the Democrat cabal running the county is in the WH, there is NO hope. Vote.

I've seen my sample ballot and there are none of The Boxen on it. Just the usual suspects.
