One state has it right

Hopefully Kansas Gov. Brownback signs it.

I am not a 1L, but I have long had angina about the effects of this type of legislation.

I support the notion but the back-side..

Native Americans have had independent control of their lands and laws forever. They have lands rights, internal police, education systems, and the ability to allow business that are not legal in the state's they live, like casinos.

The Christian Are allowed to have a separate body of law and in the case of Catholics(the Pope) and Tibetan Buddhism(Dalai Lama), internationally recognized political leaders.

Likewise other faiths have bodies of law and leadership that are allowed to control parts of their faithful.

The Hebrew religion(s) has LEGAL control of their food preparation(kosher). They also have their own school system(Yeshiva) that in most instances teaches a curriculum that is not consistent with our public school system,

SO.. I oppose Shariah law. I think is is an archaic throw back to a time when the Earth was ruled by mystics and fanatics. But how do you delineate between those that already have class standing and those you want to prevent??



As our current crop of politicians, at times, can't tie their shoes. How are they to wordsmith this new set of laws???



We are on thin ice and need to be careful...

Sam, he and the Attorney General have really riling up the liberals and moderates in the area over a variety of things......budget cuts, education, Voter ID and God. My own mother thinks Sam is a 'religious nut' and that we are heading in the direction of the neighboring bubbaville State of Oklahoma.

I think if your Gov doesn't sign it - against a 98% majority passage reflecting both state legislatures - he'd be in for an ass-whupping. Or he could sign it for the right reason.

I am not too familiar with Sharia. I have heard bits and pieces of it as reported through the media. I think some of the laws or components subjugates women, and treats them as property.

This places a huge inequality among its followers, and maybe could be a basis for striking it down, IMO. I am not aware that Judaism, or Native American laws contain this type of inequality.

Here in the US, I feel that US laws, customs and traditions should take precedence. This means if it is customary to photograph the face for drivers licenses, then that is how it should be done. If it is against Sharia law, then pethaps those individuals should consider bicycles or public transit.

Since I have not been to the sand box (and have not learned any of the customs and laws) and I don't know anyone who follows Sharia law, my views and opinnions could be a bit short sighted, but I don't feel Sharia law should even be an issue of contention here in the US.

Here is where we run into the first amendment..

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances."

and the Bill of Rights:

The government should not have the power of suspending or executing laws, "without consent of the representatives of the people,".[10] A legal defendant has the right to be "confronted with the accusers and witnesses, to call for evidence in his favor, and to a speedy trial by an impartial jury of his vicinage," and may not be "compelled to give evidence against himself."[11] Individuals should be protected against "cruel and unusual punishments",[12] baseless search and seizure,[13] and be guaranteed a trial by jury.[14] The government should not abridge freedom of the press,[15] or freedom of religion ("all men are equally entitled to the free exercise of religion").[16] The government should be enjoined against maintaining a standing army rather than a "well regulated militia".[17]




There has been many instances where both state and federal legislation has tried to limit the Church of the Later Day Saints, specifically as it deals with Polygamy. And it still happens, (ref: Sister Wives).

I understand that polygamy and honor killings are not in the same ballpark. Neither is stoning adulterers. Nor chopping the hand off a thief. But the Muslims don't see it that way.

A constitutional SCOTUS court could very well scrap these anti-Sharia laws,, unless they are written to be state specific and uniquely non federal..


Like I said,, It's a bag of worms..

Listening to the news today and Sam is signing a lot of things that are going to create shit storms from various special interest groups.

With regards to Judaism and kosher food, there is a kosher enforcement board, which makes use of mislabeled/false advertising laws to enforce that food that is labeled kosher is indeed kosher, this is probably a constitutional gray area.

With regards to yeshiva's, most(not all), teach Judaic studies in the morning and mandated secular curriculum in the afternoon. In my experience, most of the secular teachers are public school teachers as well, essentially teaching the same lesson plan twice.
