Heating & AC requirements

I have not been able to verify this as of yet, but..

I was talking to another contractor this morning about some new EPA BS that Kansas passed and that the HBA is trying to get an injunction against. During the conversation he said that ain't nothing.

Apparently tucked away in the 2500 plus pages of the HCR Bill is another form of rape regarding furnaces and AC units that goes into effect 1/1/2011. In a nutshell if your furnace is 95% efficient and AC Unit isn't 14 SEER your friendly utility will be penalizing you by means taxing you an additional percentage.

Anyone heard anything on this?

The only thing I am aware of is that there have been several instances of false and unproven products using the energy star label and EPA and DOE are cracking down on that. But I really don't follow energy issues as much as water issues.
