Gemtech Suppressor sale questions

I have a Gemtech 5.56/ .223 suppressor that I want to sell but keep getting mixed directions from the locals. Anyone know the "definitive" policy in North Carolina on suppressor sales? I have heard that the Cumberland County Sheriff will not approve the tax stamp for suppressors or other Class III weapons. Is this the case throughout NC or is it just a local trend?

NC law does not further restrict transfer of suppressors, AFAIK. The Federal NFA rules apply.

By law, the CLEO (recognized as the Sheriff) is supposed to sign off on resident's Form 4s for transfer of NFA items. In reality, he is only certifying that you he knows of no legal or criminal reasons that you cannot own an NFA item.

Some, like Sheriff Butler in Cumberland County, have decided that they will use that authority to deny NFA weapons to their citizens for other, personal reasons. I have heard that he will sign for friends and long term residents.

If sued by someone with enough money, I believe that he would lose and be forced to sign the docs. Other options include incorporating, moving to another friendlier county, etc. At one time, the PMO for Bragg could sign for Bragg residents, as it was Federal property and he was considered the CLEO.

If the purchaser resides in Harnett or Moore counties, they should have no problem acquiring the CLEO signatures on the Form 4s.

If you would like to talk to a Class III dealer, there is one in Dunn who I could recommend.
