This is, to me, a bit different than the discretion to focus on gang violence rather than littering because someone's burrito wrapper flew by. I think Senator Cruz hit it:

Well that is just dandy. Based on Ms. Napolitano's view, I recommend dissolution of DHS since the AGENCY is a complete failure and waste of tax dollars.

When scanning over Public Law 107-296, 107th Congress I do not come across any section/sub-section that gives any of them the right to selectively decide what to enforce or not. I note they can make policy in how to achieve their mission or recommend improvements (which is part of their role). Matter of fact, I believe Section 441 contradicts her limited vision.

Not to mention, isn't her AGENCY suppose to make certain that other agencies share information to ......

(A) prevent terrorist attacks within the United States;
(B) reduce the vulnerability of the United States to
terrorism;

(C) minimize the damage, and assist in the recovery,

regarding natural and manmade crises and emergency

United States is not diminished by efforts, activities, and
programs aimed at securing the homeland

(G) monitor connections between illegal drug trafficking

illegal drug trafficking.
(2) RESPONSIBILITY FOR INVESTIGATING AND PROSECUTING
TERRORISM.—Except as specifically provided by law with respect
to entities transferred to the Department under this Act, primary
responsibility for investigating and prosecuting acts of
terrorism shall be vested not in the Department, but rather
in Federal, State, and local law enforcement agencies with
jurisdiction over the acts in question.


IMO, if they aren't interested in enforcing the mission of this agency or the laws entrusted to them, get out of Dodge.

“Let me hold up a mirror right now to the whole national news media and the White House,” LaPierre said on NBC’s “Meet the Press.” Citing new 2012 data from Syracuse University, LaPierre said that out of 90 jurisdictions, Chicago ranks last.

“Why doesn’t NBC News start with ‘shocking news on Chicago, of all the jurisdictions in the country, Chicago is dead last in the enforcement of federal gun laws’?” he demanded. “Why don’t the national press corps, when they’re sitting down there with Jay Carney and the president and the vice president, why don’t they say, ‘Why is Chicago dead last in enforcement of the gun laws against gangs with guns, felons with guns, drugs dealers with guns?’”

Probably not, but what does that mean? It's okay or acceptable? This department was created to secure the homeland. Respectfully, I do not think that priorities was intended to mean what laws to uphold or not, but more in-line with budget $, resources, etc. For the record, I didn't agree with it's formation, but it is the way of Washington and how they think problems are solved. This agency has too much power over our security (ripe for abuse) to be neglient of their fundamental duties.

I have no doubt Ms. Napolitano is folloiwng directives from the President which does little to satisfy my concerns or change my view that this monolithic agency is not worth Americans hard earned dollars.
