"B. An order requiring Defendants to account for and pay to RMDI all damages
caused by their infringement of the ’900 Patent, whether lost profits or a reasonable royalty, and
to enhance such damages by three times in light of Defendants’ willful infringement, all in
accordance with 35 U.S.C. § 284;"
This is interesting in that Robinson is alleging damages, but wants the defendants to calculate how much those damages are. And here I thought Plaintiff had to allege $70K plus $.01 to go Federal. I'd like to see Magpul and the Freedom group respond that any damages, if they in fact exist, as derived from the financial impact of a part of the weapon system which is nice, but not mission critical, amount to some dollar figure well below $70K. Since Robinson didn't allege a fixed damages amount, that should get the suit dismissed.
Between this and the Hyperstealth allegations, SHOT should be...interesting this year.
