If they do hear it, the results may be far reaching.
Given the current makeup of the Court, and the age of some of the Justices, I doubt that we will have a better shot at a positive outcome anytime in the near future.

It will be a while before it gets to the SCOTUS, as there is a petition for rehearing en banc currently pending before the DC Circuit.
