I am just hoping my Form 4 passes through before the Messiah passes judgment on Heller.

GratefulCitizen 01-21-2009 21:47

I believe this was published too soon for the President (that was painful to type) to stop via this method.

According to the Federal Register, it was published on Dec. 10, 2008 and became effective on Jan. 9, 2009.

The regulation should have to be reversed by the same process which it was changed.

If it became final in January, that means it has passed the 60 day rule. This has been getting worked on for more than a year. Besides, this amends the provisions to reflect state law.

Also, the Yahoo article culled down a longer, more explicit article that explained that the rules already finalized would not be overturned without new legislation going into place.

Quote:

The Bush administration worked diligently to get its changes in place before Obama took over, moving into overdrive in the last year on a host of new regulatory proposals. In some instances, Bush advisers put the finishing touches on proposals in time to have them passed one day before Obama's inauguration -- federal law requires a 60-day waiting period before any major changes become law.

Those rules included a "right of conscience" law that allows medical providers to refuse to offer any practice they find morally objectionable, including abortion and other reproductive-health procedures.

Another regulation overturned a 25-year-old federal rule that severely restricted loaded firearms in national parks.

Obama has said he would work to reverse the rule changes. But because these rules took effect before he was sworn in, he cannot simply kill them with the stroke of a pen. Presidents have the power only to revise regulations without the approval of Congress before they are passed into legislation.

Obama will either have to restart the lengthy rulemaking process, or rely on Congress to reverse the changes of Bush's finalized regulations. A spokesman for the White House could not be reached Wednesday.

True, but with control of both houses he has few obsticles.

Welcome to Hell with the new Personal Jesus.

Knee jerk reactions. Legislation, rules and the like take time. He is jumping through his ass now, but in a few weeks the furor will die down.
Everyone please follow my directions:

"In the case of the President gone wild, please exit the doors located nearest your seats. At this time locate those emergency exits. Feel free to trample anyone in your way. Old ladies and gun owners be damned. Thanks for flying OBAMA Airways, and have a nice flight.":D

If they can't get it one way, they'll get it another...

Separation of powers...bah, who needs it.
Let federal judges run the country by fiat.

That's correct it should. As a former Park Officer I watched the regulation's progress with interest over the past year. I was very glad to see it get approved and become effective. They are violating procedure with this back door approach. It should be interesting. The Sec of the Interior, Ken Salazar, is a pro-gun Democrat. He was previously the senator from my district. I've written him a letter asking for his views.

Personally I think it is ridiculous that the President of the United States is more concerned with bowling, CCH in parks and the NCAA brackets than he is in getting the crooks stealing our money in jail. I would have had all of the leadership in AIG answering to a judge by now. This country is starting to slide, BAD.

True, but they are/were large campaign contributors and they get a 'Get Out of Jail Card'.
