It depends on the QUESTIONS you ask! Silly Rabbit.

Q 1) Good morning Madam Secretary, thank you for coming in. Isn't it a beautiful day?

A 1) Yes.

Q 2) Madam Secretary, have you made mistakes in your life?

A 2) Yes.

Q 3) Madam Secretary, could you expand on that?

A 3) Yes.

Q 4) A little more detail?

A 4) Well, yes.

Q 5) Madam Secretary, could you explain your involvement in the misappropriation of classified government documents, transmitted and received via a private and non-secure server in violation of several known rules, regulations and laws established to protect such nationally sensitive information that it could cause irreparable damage to our country and national security?

A 5) No.

Thank you, I think we are done here. Have a nice day!

Oh, Madam Secretary, one last question. "Do you know the circumstances and how Vince Foster died?"

Yes.

Thank you. We're finished here.

Consider what the consequences would be if thr Chinese or Russians have hacked and copied Hitlery's emails and she is elected.
1. They contact her with proof and they own her.
Or
2. She doesn't cave and we have a national crisis.:munchin

Comey testifies Clinton email claims ‘not true’ at heated Hill hearing

Published July 07, 2016

FBI Director James Comey testified Thursday that Hillary Clinton’s claims -- some made under oath -- about her use of a private email server were “not true,” fueling Republican questions about whether in doing so she committed a felony.

In a wide-ranging appearance before the House oversight committee, Comey also said Clinton’s email practices put America’s secrets at risk and her actions constituted the “definition of carelessness.”

At the same time, Comey staunchly defended the bureau’s decision not to pursue charges. He also said, “We have no basis to conclude that [Clinton] lied to the FBI.”

Yet he acknowledged that lying under oath is a felony, as some Republicans point to statements she made last October before the House Benghazi committee -- and plan to request an investigation. At that hearing, Clinton had claimed that nothing she sent or received was marked classified.

Comey was asked about such claims, which she also made publicly, in a pointed exchange with Rep. Trey Gowdy, R-S.C.

“That’s not true. … There was classified material emailed,” Comey said.

On her claim that she used one device, Comey also said, “She used multiple devices.”

And on her claim that she turned over all work-related emails, he said, “No, we found work-related emails, thousands that were not returned.”

Quote:

"In our system of law there's a thing called mens rea. It's important to know what you did. But when you did it, this Latin phrase mens rea means: What were you thinking?" he said, waving his hands like a law professor in front of a classroom of first-year students (we assume.) "And we don't want to put people in jail that they knew they were doing something they shouldn't do."

As to how that applies to the Clinton case:

"I see evidence of great carelessness, but I do not see evidence that is sufficient to establish that Secretary Clinton or those with whom she was corresponding with ... knew when they did it they were doing something that was against the law." https://www.washingtonpost.com/news/...intons-emails/
Mens rea: the intention or knowledge of wrongdoing that constitutes part of a crime, as opposed to the action or conduct of the accused.

Quote:

Supporters of Hillary Clinton should have a new appreciation for the legal concept of mens rea—literally, "defendant's mind"—because it looks like it will save her from federal prosecution for her use of a personal email server as secretary of state. In recommending that the Justice Department not bring charges against Clinton, FBI Director James Comey distinguished her "extremely careless" handling of "very sensitive, highly classified information" from previous cases involving "intentional and willful mishandling."

Not every potential federal defendant gets the benefit of such distinctions. Consider the retired racecar driver on a snowmobile outing in Colorado who got lost in a blizzard and unwittingly crossed into a National Forest Wilderness Area, the Native Alaskan trapper who sold 10 sea otters to a buyer he mistakenly believed was also a Native Alaskan, and the 11-year-old Virginia girl who rescued a baby woodpecker from her cat.

The first two of these incidents resulted in misdemeanor and felony convictions, respectively, while the third led to a fine (later rescinded) and threats of prosecution. All three qualify as federal crimes, even though the perpetrators had no idea they were breaking the law
—a kind of injustice that would be addressed by reforms that opponents falsely portray as a special favor to corporate polluters and other felonious fat cats.

The federal code contains something like 5,000 criminal statutes and describes an estimated 30,000 regulatory violations that can be treated as crimes. The fact that no one knows the precise numbers is itself a scandal, compounded by the fact that many of these provisions include minimal or no mens rea requirements, which specify the mental state required for conviction.

The upshot is that innocent acts, honest mistakes, and simple accidents can lead to criminal convictions that deprive people of their liberty and property, ruin their reputations, and carry lifelong collateral consequences ranging from impaired occupational opportunities to the loss of constitutional rights. That's a serious problem recognized by Democrats as well as Republicans, as demonstrated by the bipartisan support for mens rea reform in the House of Representatives.

Yet Senate Democrats dismiss the proposed changes, which would add culpability requirements to statutes that do not address the issue, as "corporate protection." They blame Republican insistence on mens rea reform for imperiling a criminal justice reform bill that until recently seemed likely to pass this year.

It would be a shame if disagreement on this issue prevented Congress from reducing excessively harsh federal sentences. But Senate Democrats' critique of mens rea reform is seriously misguided, if not downright disingenuous.

Their chief complaint, also voiced by the Justice Department, is that requiring the government to prove a defendant knew he was breaking the law will make it harder to convict people. No kidding. The same could be said of many safeguards widely supported by civil libertarians, including the presumption of innocence, the exclusion of illegally obtained evidence, the requirement of proof beyond a reasonable doubt, and the ban on double jeopardy.

No doubt guilty people, including violent criminals, escape conviction because of these rules. Likewise, if Congress beefed up federal mens rea requirements, some white-collar malefactors probably would escape criminal punishment as a result. But that prospect should not deter Congress from doing what's right.

"The critics of mens rea reform—there's no way of overestimating the cynicism of these people," said Harvey Silverglate, a leading critic of overcriminalization, in a recent interview with Reason TV. "They're saying, 'It would be a terrible thing, because the people we don't like—corporate executives—they will be able to get off by arguing that there's absolutely no criminal intent on their part. So you want absolute criminal liability for people you don't like. However, when they come at you, suddenly you say, 'Well, I didn't intend to break the law.'"

That defense is deeply rooted in our moral intuitions and legal traditions. As the Supreme Court observed in 1952, "The contention that an injury can amount to a crime only when inflicted by intention is no provincial or transient notion. It is as universal and persistent in mature systems of law as belief in freedom of the human will and a consequent ability and duty of the normal individual to choose between good and evil."

To impose criminal penalties on people for inadvertent violations of the law is plainly unjust, regardless of their occupation or social class. That the guilty will sometimes benefit from this principle is no excuse for denying its protection to the innocent.

Some here may likely know this, listening to the hearing today I just learned that Hillary Klinton was one of the Original Classification Authorities. How is it even possible that she can play "I didn't know" with this?

We had a big discussion about this on another board. She's the OCA for information originating with DoS. Information that came from other agencies or that is up-classified by other agencies would not necessarily be known to be classified by SoS unless it was carrying the appropriate markings. I hate it, but it's correct.

As an OCA, she can also wave her hand and downgrade the classification of various information that originated within her department with nothing more than a memo. My contention is that had she been charged she would have been able to produce memos for all of the DoS originated emails. (backdated, of course).

On a side note... isn't the person or persons who removed SAP info from the SCIF guilty as hell? That's not mishandling, it's deliberate espionage.

That's all a bit of hogwash!

Sure, she and those appointed by her (Chief of Staff and a handful of others) could write and generate classified documents and working papers until such time as making them 'originally' classified but to purposely omit national standards in markings and subsequently protecting them afterwards is tantamount to violating a dozen or more federal laws. (The "I didn't know excuse," has a bursting radius of everyone is infected until proven otherwise.)

Those already marked by other agencies and departments would be marked with appropriate markings and declassification dates. Depending on the material, sources, and methods of collection or origination most all would have all been declassify on some year 25 from then and upto 75 years to never!

If she or someone in her staff gained access to SAP that were generated before January 1, 1982 they wouldn't declass until December 31, 2021 (unless extended to forever) and those documents after January 1, 1982, have 40 years before being looked at for declassification. She wouldn't be able to simply say, "oh that's not important."

The FBI failed to round up everyone and hold accountable for violating E.O. 13526, DoD Directive 5205.07 and probably the Atomic Energy Act of 1954 if what we think she may have sold or compromised.

She and many others broke the law, and walked. Intent is not needed!

I removed SAP info all the time, briefed the commander and returned the info to the proper place. Had I sent or received SAP information to my house or anyone else's house I'd been Chelsea Manning's bitch for life.

SAP info was so sensitive if it was on a hard drive that hard drive was removed from the computer and locked up. We did that every day.

The problem is DOS never originates TS material and damn sure not SCI. INR summarizes other Intel pieces from other sources but DoS originated info is pretty easy to ID. But then again, Director Comey said it was very possible that she wasn't "sophisticated" enough (e.g. Intelligent) to understand that (C) indicated Confidential classification. Perfect person to be the ultimate decision maker for the NCA.

That cuts to the heart of the matter, it's astounding how this proven incompetent would even be considered for a role in government at any level, the details are merely the result of that failure, she was removed as SOS, she lost a run for POTUS against the first term senator and somehow that makes her eligible to run for POTUS

OK, here's the one I was looking for. It's in EO 13526

Quote:

PART 3 -- DECLASSIFICATION AND DOWNGRADING

Sec. 3.1. Authority for Declassification. (a) Information shall be declassified as soon as it no longer meets the standards for classification under this order.

(b) Information shall be declassified or downgraded by:

(1) the official who authorized the original classification, if that official is still serving in the same position and has original classification authority;

(2) the originator's current successor in function, if that individual has original classification authority;

(3) a supervisory official of either the originator or his or her successor in function, if the supervisory official has original classification authority; or

...
https://www.whitehouse.gov/the-press...ty-information
I didn't say it was right to do that, I just said she had the authority as the OCA while she was SoS. The expiration dates actually don't matter for an OCA's decision to declassify, they simply have to meet the "determined that it no longer meets the requirements" standard. The OCA is the one that makes that determination. Again, this is only for things that the DoS owns, whether via origination or via transfer. I was suggesting that she could break a couple more laws and probably get away with it since she most likely still has an electronic copy of DoS letterhead with her signature block. Presto change-o she generates a few backdated memos and has a friend(co-conspirator) drop the memos somewhere at DoS where they can be "discovered" and any of the info she had the authority to classify is no longer a crime. That still doesn't account for the info that originated with other agencies.

I know where you're coming from. I had some of those IA/IASO certifications as well (within the last 5 years) and had to learn all about it. I was simply positing an unlikely scenario that someone as crooked as her and as well connected could attempt and possibly succeed with.

Badger52 07-07-2016 20:52

Here are some names of people in DoS who probably will face loss of job, lost wages, or jail time in a federal prison. Or should!

Quote:

Kirby told the Associated Press that former officials can still face “administrative sanctions.” The most serious is loss of security clearances, which could complicate Clinton’s naming of a national security team if she becomes president.

Beyond Clinton, the probe is most likely examining confidants Cheryl Mills, Jake Sullivan and Huma Abedin, AP reported. Abedin wrote many of the emails that the various investigations have focused on, AP noted. Mills, Clinton's chief of staff at the State Department, has been viewed as a possibility for the same job in the White House. There is speculation that Sullivan, Clinton's former policy chief, could be national security adviser. USA Today State Department Probe.

We (and the FBI) wouldn't be having this discussion over material "deemed" unclassified because it's no longer relevant.

We are not talking about travel itineraries and locations for lunch with foreign diplomats and host country heads of state.

This bitch traded national secrets and war plans with foreign heads of state through her private server for political gain or financial advantage.

Any one of us would be thrown under the bus and backed up over for far less!

I'd really like to know 'WHY' the Director of the FBI is tap dancing around like a puppet without strings attached. And why Bill Clinton had to share his 'personal' grandchildren stories with the AG just prior to this announcement of, let's rewrite the federal code for enforcement of existing laws?

Putin controls the next election: If he wants Trump in, he releases (or leaks) information hacked from Hildabeast's servers. If he wants Hildabeast in (likely, for blackmail reasons), he does not.

But, he's not the only world player in this game, just the biggest. Putin could be trumped by smaller players (no pun intended). This is very bad.

Doubtful; if still employed they would probably be sentenced to 816 Power Point slides. If agencies could be relied upon to effect their own remedies they wouldn't need repetitive hearings to find out if anyone at the VA's been fired.

I can tell you I was not astonished to find the same lazy-faerie culture at State that I found in 79-80 when at the Puzzle Palace trying to keep up secured point-to-point circuits with them (they had some people in Iran they sounded like they might want back). It's in their DNA; the whole crew down at Brandy are much too genteel ladies & gentlemen to be bothered by mere rules - "pish-tosh." Their security awareness sucked then; it still sucks. David Bolgiano had some articulate words on his "Hunting Saracens" blog regarding this; among others...
Quote:

When we, the unprotected, begin to realize that peaceable resolutions to such obvious wrongs are ignored, the result may not be peaceable at all. In even plainer terms, do not expect proud and skilled warriors to stand by and watch the Constitution to which we swore an oath be trampled upon by treacherous thieves like Hillary Clinton.
We'll see.

Yup, agree it's over, but it was a great run.

Time to prepare and plan.

Just what kind of plans are you insinuating?

I personally that we should have a nice mixer to promote "awareness" and "tolerance" in terms of what comes next.

This walking cunt wearing a $12,500 pants suit is not suited to steal the rest of our oxygen, let alone lecture the rest of us about how we need to live our lives.

What am I insinuating? I'm not insinuating, I am pointing a finger and telling people to start preparing and planning. I am saying tyranny has taken hold in the United States. I am saying that the administration and some federal agencies are complicit in a criminal cover-up of a corrupt political party and individual. I am saying that the DOJ and FBI are complicit in a criminal act perpetrated upon the people of the United States.

I am saying that because of this criminal act the people of the United States are rendered powerless by the criminal conspiracy of the administration, the DOJ and the FBI. The people of the United States are also hamstrung by the inaction of the spineless RINO republicans currently in office. And even when one of them makes a stand they will not all stand together to stop the criminal socialist conspiracy.

Never before has the American people had their faces so blatantly rubbed in corrupt socialist shit and forced to tolerate it. This can only occur when a corrupt administration and other corrupt federal agencies work together.
It's time for the people of the United States to make a stand for their own freedom and to put an end to the government corruption.

I only see two futures for America, an oppressive socialist/communist future or a free future. There is no third future. The decision will be made in Nov on which path the United States follows.

Do we want to control the government or do we want a (corrupt) socialist government that controls us.

When the leadership of the United States is above the law of the land, when government officials can willfully commit a criminal act so grievous that any other American would go to prison and they walk scot-free then it's over and the end is near.

The gender confused leaderless military will not be of any assistance. We are on our own.

We either take it back or bow our heads and get in line with the rest of the sheeple.

I agree with you 100%.

Sometimes the sarcasm doesn't translate over script.

With all that being said, I will not be voting for Donald Trump. I will be voting AGAINST Hillary Clinton. Being that the election isn't tomorrow I refuse to capitulate and get on the train. I feel that being critical of his actions will assist in moving him right versus left. He has a golden opportunity to capitalize on the words of Comey during his press release and the congressional testimony. He should be conspiring with those who are more capable than him in terms of exposing her flaws, poor decision making ability, and her trustworthiness.

Instead, he basically called her a poopy head and moved on.

While I may hold my nose and vote for him...........I will not stop being critical of him.

I will give him credit for his handling of the Dallas police shooting, in which he handled quite well. However...........that doesn't change the fact that the shooting has taken the air out of the sails of the email issue. Every second that we sit idly, the public becomes more susceptible to alinsky style indoctrination from the administration on issues like gun control and racism.

As predicted by the Committee that heard Comey

as well as most thinking people watching the circus...

Not long to get this one in the news...

A U.S. Marine officer facing involuntary discharge for improperly handling classified information is hoping to receive the same lenient treatment the FBI recommended for former secretary of state Hillary Clinton.

Maj. Jason Brezler has been embroiled in a legal battle since December 2014. Brezler is facing an involuntary discharge from the service after he admitted sending classified information to an unclassified email address in 2012. He was trying to warn fellow Marines about a corrupt police chief in Afghanistan. Several weeks later, a deputy of that police chief killed three Marines in a rifle attack.
