Post Sadahm Trial

Yesterday I saw Judge Napolitano say that one mistake the prosecution can make is to over charge. They should only prosecute that which is a "slam dunk" such as mass killings. As he said you can only execute him once.

Sure enough, Sadahm went right at the charge of invading Kuwait. I think they should have left that one alone. It may have opened a Pandors's Box. Sadahm claimed that Kuwait was "slant drilling". In essence (according to him) they were stealing Iraqi oil. This can put the tribunal in the situation of having to defend Kuwait. Thinking back to the "Teapot Dome" scandel right here in the US he may have a point. I believe I would drop that charge quickly.
