Sergeant on Trial on Charges Related to Allegedly Calling Soldier Fat
8 Jan 2019, Stars and Stripes | By Nancy Montgomery

VICENZA, Italy -- A sergeant first class pointed an unloaded pistol at one soldier, called another fat and touched the hair of a third, prosecutors said at a special court-martial Tuesday.

"It's not the crime of the century," Capt. Justin Kman told a nine-man panel. "But it's a crime."

I find it revolting that people can be prosecuted for hurting others feelings.

Personally, I am offended by that....

Jury acquits senior NCO accused of pointing weapon at soldier and calling another fat

By NANCY MONTGOMERY | STARS AND STRIPES Published: January 9, 2019

VICENZA, Italy — A senior noncommissioned officer accused of pointing a pistol at one soldier, calling another fat and improperly touching a third’s hair was acquitted of all related charges at her court-martial Wednesday.

Sgt. 1st Class Jessica Barboza was found not guilty of dereliction of duty, maltreatment and disrespecting an NCO by a panel of nine male officers and senior NCOs. At least six of them had to agree to acquit.

“I’m relieved,” said Barboza, 35, of the 2nd NATO Signal Battalion in Naples, “I’m just grateful to the jury members.”

Criminal charges were brought against Barboza after she declined to accept nonjudicial punishment, following a command investigation into complaints about her more than a year ago.

“You won’t see these crimes on ‘Law and Order,’” prosecutor Capt. Mike Gerrity conceded in his closing argument. “But this is the military. Sergeant 1st Class Barboza failed to put her soldiers’ needs above her own.”

Testimony against her included that of two soldiers who said she’d pointed a 9 mm pistol at one of them during weapons training, which Barboza said wasn’t true. Another soldier said Barboza humiliated her by repeatedly calling her fat, while an African-American staff sergeant said Barboza had touched her hair without permission and then called it “nasty” when rebuked.

Hold on to your testicles, (is that PC) as I don't want to offend anyone with grab your nuts, because this subject matter is being rolled out by the progressive left to not just neuter speech, but to beta your ass. This will increasingly become the social media story of 2019.

Opposite of that, you won't find this story on main stream media:

This isnt a case of toxic masculinity in the c;classic sense - to the contrary - SFC Barboza is an American-Mexican female.
I imagine that SFC Barboza would have experienced a different outcome as a male NCO - probably an even greater difference in outcomes as a non-hyphenated male NCO - but I could be wrong.

Not that it should matter since all soldiers are same-same - I'm just guessing her gender and hyphen status probably helped out in this case.

Let us all get our vagina hats, give up our guns and ammo, quit working out and doing the studly man---or manly stud stuff that makes men outta boys, and start taking estrogen shots. We have to give up our masculinity lest we foster sexual harassment and homophobia and other undiscovered(made up) problems that it causes.

Give it up and whack em off.

Jonathan Haidt is a pretty interesting cat. This is not anyone who even remotely aligns himself with the "Right" but like a lot of ACTUAL scientists sees the dangers of the path that the leftist whack-o-crats are moving down.

Now that was a smart defense attorney and demonstrates one of the few times it
is the best interest of the accused to have court-martial with enlisted members.

Upon request, an enlisted accused is entitled to have at least 1/3 of the panel
(jury) composed of enlisted members.

Since a court-martial requires a 2/3 vote to convict, there must be enough
enlisted members of the panel to ensure acquittal if they all vote "not guilty."

(Disregard that part of the Stars and Stripes article that said 6 members, or 2/3
of the "jury" had to vote for acquittal. It's the opposite).

While some young dumb accused ask for enlisted members in the belief that
they will get PV2/PFC Joe Tentpeg on the panel, the reality is that the enlisted
members will be senior NCO's, MSG/1SG/CSM who will nuke a truly guilty EM
far worse than an all officer panel. But those same grey hair NCO's are the best
line of defense for an NCO accused of the bullshit charges levied against SFC
Barboza.

And I'll bet that -- for most of not all of the NCO members -- there was a certain
amount of "there but for the grace of God go I" based on past behavior.
