A federal district court judge has overturned the sentence of Lee Boyd Malvo, one of the two people convicted in D.C.-area Beltway sniper attacks nearly 15 years ago, according to a ruling released Friday.
Malvo was sentenced to life in prison without parole for the sniper-style attacks committed around the region in October 2002 along with John Allen Muhammad. Ten people were killed and three others were shot during a three-week period.

You have to be kidding me. Both of those turkeys should have gotten the chair years ago. It is getting almost impossible to respect to the judicial system.
Malvo's case has been remanded back to Spotsylvania County Circuit Court to issue a new sentence.

Every double edged sword should cut both ways. You could have lived out your juvenile discretions watching bay watch reruns but since you took the offer you may not like the consequences.

Can they re-try him? Wouldn't some sea-lawyer snake bait say that's double jeopardy? Wouldn't this rather be just a juvenile sentencing hearing? Worst this dude will get is time already served.

Not a retrial. He's already been convicted of capital murder in two states with aggravating circumstances. He's going to get a new sentencing trial in one or both states. If one has the death penalty they could go there (but not likely) he's already cost the states millions.

But, sentenced as a juvenile or an adult? The Fed Court decision seems to say the life w/o parole was a cruel sentence given that he was 17y/o. If memory serves he took a plea deal to avoid the needle in exchange for his testimony against his butt-buddy, and there was a prosecution decision to try him as an adult.

You have your facts straight as I recall, too. Malvo is a creepy shit. Got away with murder. But, I'm with Billy L-bach: Turn them all loose. Then come up with a realistic and affordable bounty. Easy-cheesy.

Will this this punk ever be a productive member of society? I cannot imagine him ever doing anything positive. And what about the suffering of his victims and their families. Any remorse?
Lucky to get LWOP. I would have preferred to see him get a short drop on a long rope; to save the taxpayers money, deter others, and likely prevent future offenses by the scumbag.
And it isn't the little weasel pulling this, it is a whole crew of lawyers trying to save the poor wretch from the consequences of his murderous actions. Our legal system is becoming a total fraud.
I would also like to see them locate a halfway house for him next door to the judge and Malvo's attorneys could demonstrate their faith in his rehabilitation.

Commute the sentence from life to 60 years and then parole. It was done in Iowa back in 2012 by Governor Branstad. These POS's do not have to be released.
Lawyers acting for prisoners given mandatory life without parole sentences for murders they committed aged 13 to 17 are vowing to challenge the governor of Iowa, Terry Branstad, over his open defiance of a recent US supreme court ruling that bans such penalties.
Branstad, a Republican, wielded his executive powers last week to ensure, in effect, that none of the 38 juvenile murderers in Iowa who were sentenced to die in captivity will ever become free. The governor commuted their sentences, as he is required to under the supreme court judgement issued in June that prohibits mandatory life without parole sentences for offenders convicted of murders they committed under the age of 18.
But Branstad went on openly to confound the ruling of the highest court in the nation by imposing an alternative 60-year sentence on all of Iowa's 38 prisoners in that position. Taking their median age at the time of offences to be 15, that would mean that the first time these individuals could even apply for parole would be at the age of 75.
