Is this good or bad? I know seizure without adjudication is wrong and this never should have happened in the first place, but the timing? What is the back-side story?


Can the Feds still seize property, just not the locals?
Does Holder want more than the current 50/50 split?

Holder doesn't do anything that doesn't benefit berry and himself.

Is berry pushing to hide his assets from seizure in case he get impeached?

Just my opinion.

You may be correct.

I see it as a stupid move to piss off all the state LEO orgs that are underfunded.

Granted it was wrong in the first place.. :confused:

Local and State Law Enforcement has been using the federal law and there are thousands of documented abuse of the law. It was intended to put a dent in illegal activities but some sheriffs found an easy revenue stream that did not have to be justified. This was for the war on drugs. As we all know the very best intention can be warped and miss used. I have never liked how some people used this law so heavily while some just applied it if needed for leverage to move up the investigative process to bigger targets.

Anything criminal using weapons will always be amplified if a weapon is involved. Even if they just had it in the car or house while committing the crime.

This is a very good thing. From what I've read, local LE have been using Federal civil forfeiture policies and statutes to override state and local attempts to reign in the practice. This removes that prop. A first step to removing the shameful abrogation of the Fourth Amendment.
