Now it looks like HIPPA Laws can be used against you now?
I saw this article posted on another forum. Doesn't seem to have much truth behind it.
Also haven't seen it on any reputable news reports.

Snaquebite, I see what you are referencing, but I still don't know what the actual "Loophole" is. Having had hours of HIPPA training and having acted as an expert med mal defense witness on one occasion, I've never heard of anything like that. It is difficult to subpoena private health records and difficult to get permission for healthcare professionals to testify on a patient's medical conditions and treatments. That being said, I do know that insurance companies are able to access old medical records to determine pre existing conditions. But that is, I believe, only with the consent of the applicant. It will be very interesting to find out the rest of this story. Of course, once ACA (obamacare) kicks in, the government will be present to witness your prostate exams.....Or at least have unprecedented access to your medical records, being the insurer.

Reading the FOX article it says it was a case of mistaken identity (how many guys named David Lewis can there be in New York?). Looks like Mr Lewis released the information about his use of mind altering drugs or whatever they were.
If HIPPA is being violated that is a very serious breech of the First Amendment. We shall see.
I wonder how many bar complaints have been filed against the attorney of record. (Not really)

The "loophole" was explained today on FOX. They quoted the provision in HIPAA. It appeared to me to be a matter of interpretation. Can't find a written story. Basicly, the way NY is interpreting it is. If it's in the best interest of the State, they can access restricted records covered under HIPAA without permission.

I wonder how many criminals the legislation created, how many people's rights will be violated, and how much property will be taken without due process, as part of this commonsense legislation to prevent gun violence?

If HIPPA is being violated that is a very serious breech of the First Amendment. We shall see. Quite so sir. They apparently got the right NY-state lawyers to tell them that it's OK to have the Health Department troll for prescriptions written for certain things, and have given themselves permission to make a decision that should be reserved to a court that denies a right & confiscates property. That is not a small thing.

Something I noticed when I went for a check on my heart a few months ago was the hospital forms had one that basically has the patient signing an understanding of HIPPA laws, but that Law Enforcement Agencies can obtain this information during the course of an investigation.
To me, it was the hospital getting a patient signature on a document to limit their liability if the patient's records were released.
As we watch what is happening with gun control, we can see where the Feds are attacking on seevral fronts. The use of "health concerns" and "enviornmental concerns" with the CDC and EPA are being fired up for greater use.
New York State is using pharmacy prescriptions to review a permit holder's eligibility, I have been told.
What happens when a family member is prescribed medication that falls into the "mental health" net being cast very wide? Does the NY State permit holder have to surrender their guns because the family member resides under the same roof? What about those people that rent and share a common address?

Another part of this proposed legislation that bothers me is the clause that states if any clause is ruled null by a court, all other clauses stand on their own.
So a liberal court finds that it's unconstitutional to prevent a gun-registry... Viola' you have the registry to start confiscation...
