CHICAGO (AP) -- A federal appeals court has struck down a ban on carrying concealed weapons in Illinois -- the only state where carrying concealed weapons is entirely illegal.

The 7th Circuit Court of Appeals announced Tuesday that state lawmakers have 180 days to write a new law that legalizes concealed carry.

The ruling is a victory for gun rights advocates, who argue that the prohibition against concealed weapons violates the U.S. Constitution's Second Amendment and what they see as Americans' right to carry guns for self-defense.

Attorney General Lisa Madigan's office says it is reviewing the ruling and would comment Tuesday.

The ruling stems from a lawsuit filed by former corrections officer Michael Moore of Champaign, farmer Charles Hooks of Percy in southeastern Illinois and the Bellevue, Wash.-based Second Amendment Foundation.

I'd be happily shocked if there wasn't a further effort to at least tie up the courts further, with injunctions pending SCOTUS appeal (existing case law notwithstanding). Whatever Play-Doh can be rolled up and stuffed in holes in the boat.

It's still one for the good guys.

Perhaps they'll just take the approach that FOIDs are no longer needed, Big Sis' NICS works, so if you can own it, you can carry it, with no need for classes.

House Majority Leader Barbara Flynn Currie, a longtime gun control advocate, said she hoped the state would appeal the ruling. But Currie also said lawmakers must “get cracking” on how to respond to the ruling and begin parsing its key points.

Currie, D-Chicago, said that “justices surely do not mean that we would have to have wide-open” laws in Illinois. She said Illinois must now look at what other states are doing, such as disallowing guns in day-care centers and other locations.

“If we need to change the law, let us at least craft a law that is very severely constrained and narrowly tailored so that we don’t invite guns out of control on each of our city’s streets,” Currie said. “I don’t want people out of control wandering the streets with guns that are out of control.”

Typical Chicago Idiot. The only guns that are out of control in IL are the gang bangers. And I bet not one of of them got the gun legally.

Why is it so hard for people to understand that criminals are not going to follow laws banning guns?

But I bet all these Chicago dim wits have security that carries concealed. Or how about the local politician that got a waiver, and then got caught carrying his .22 through security at O'Hare.

It always brings great relief to to me whenever I see a would-be criminal or gang-banger carefully read and thoroughly understand the posted "No Guns Allowed" notices prior to entering a bank, school, movie theater, etc as they unholster and secure their weapon.

Just to keep things in prospective, most gang related shootings involve other gang members. It's just culling the herd.

You assume a "shall issue" carry law.

I would not expect that to be the case in Illinois.

Only a few well-placed individuals will qualify to carry, IMHO. Like the City Councilmen and Congresscritters.

....Just to keep things in prospective, most gang related shootings involve other gang members. It's just culling the herd.

Are they so accurate as to never hit innocent bystanders?

Hopefully a retired Lt Col with 28 years of honorable service and an active duty one with 18.5 will be two of them :)

TRYep. That would be using the Circuit's language in the decision allowing the state to use "reasonable" safeguards to public safety.

Innocents do suffer the consequences of gang violence. CCW will never mitigate that tragity. But more often than not, the offenders are shooting into a group of "individuals" loitering in an area know for gang activity. What's in vogue these days are drive by shootings at gang funerals. You see the warring factions see this as an excellent opportunity to strike when the hierarchy of another gang gather to pay tribute to their fallen.

Apparently one of the prominent legal-eagles cited by both the sides of the court opinions is indicating that the state house in IL is - in terms of numbers to achieve a majority - in favor of shall-issue.

You are so right! There are days (most every) that my right thinking brothers in arms and myself on the job feel like our politicians tie one hand behind our back and then throw the citizens to the wolves. Our mayor, the ballerina, believes people don't deserve the right to protect themselves.
