Rahm Emanuel should not appear on the Feb. 22 mayoral ballot, according to a ruling issued by a state appellate court today.

In a 2-1 ruling, the appellate panel said Emanuel does not meet the residency requirement of having lived in Chicago for a year prior to the election. The judges reversed a decision by the Chicago Board of Election Commissioners, which had unanimously agreed that Emanuel was eligible to run for mayor. (Read the ruling here.)

"We conclude that the candidate neither meets the Municipal Code's requirement that he have 'resided in' Chicago for the year preceding the election in which he seeks to participate nor falls within any exception to the requirement," the majority judges wrote.

"Accordingly, we disagree with the Board's conclusion that he is eligible to run for the office of Mayor of the City of Chicago. We reverse the circuit court's judgment confirming the Board's decision, set aside the Board's decision and ... order that the candidate's name be excluded (or, if necessary, removed) from the ballot."

The majority opinion was written by Appellate Justice Thomas E. Hoffman and concurred with by Presiding Appellate Justice Shelvin Louise Marie Hall.

Appellate Justice Bertina E. Lampkin wrote a dissenting opinion.

"I disagree with the majority's contrary conclusion that the candidate is not eligible to be on the ballot because that conclusion is based on an analysis of two issues --- establishing residency and a statutory exemption to the residency requirement --- that are not relevant to the resolution of this case."

Emanuel's campaign has not commented on the ruling, but previously both sides in the case said they planned to appeal the case all the way to the Illinois Supreme Court.

Time is of the essence, however. Early voting starts a week from today on Jan. 31.

The appellate court judges heard the case last week.

Opponents say Emanuel doesn't meet the one-year residency requirement because he was in Washington serving as President Barack Obama’s chief of staff.

Before today, Emanuel had won rulings by the election board and in Cook County Circuit Court. Today’s ruling seems certain to be appealed to the Illinois Supreme Court.

One would think he would have had all his ducks in a row before taking a shot at Mayor. I think he put the cart before the horse with this one; however, I also think he might have felt he was above any possible scrutiny concerning his residency requirements.

An ex- White House Staffer is expected to follow the rules like anyone else.......Imagine the insult Herr Emmanuel must be feeling. Guess the obama "clout" is not so effective in Chicago after all:boohoo.

Maybe it is. Rahm's part of the reason Obama's first two years sucked so bad.

Don't worry - Al Sharpton will show up with some "walking-around money" and he'll be back on the ballot before the election. The mafia has NOTHING on Chicago.

No, from the sound of it he is, along with the rest of the politicians in IL, above the law. He's going to the IL Supreme Court...wonder how that will work out for him. :munchin

What are you talking about? His residency requirements are squared away. After all his piano and his wife's fur coat are stuffed in a basement in Chicago. What else do you want? Sheesh.:rolleyes:

(Looks like he and his ex-boss have a lot in common in that they both share their difficulties proving their legal residency/citizenship status for office). :D

Naw, Jim. Ol' Rahm (-a-lama ding dong) is Jewish. Al doesn't like Jews! Crown Heights Riots showed that.

This is an interesting twist in the turn of events for Rahm, wonder how its going to play out. We have already seen that "papers" or lack thereof, doesn't matter.

The Illinois Supreme Court has halted the Chicago Board of Elections from printing any mayoral ballots without Rahm Emanuel's name on them.

The high court is still determining whether to consider an appeal filed by Emanuel after a state appeals court ruled that he could not run for Chicago mayor because he didn't live in the city for a year before the Feb. 22 vote.

The regulations specifically state you must reside in the city no less than 1 year to be put on the ballot. I don't know WTF these people are doing wasting more money. Oh right, the rules don't apply to them. :rolleyes:

Some say the Daley Machine is putting the screws to Rahm and messing with him...I wouldn't consider this a done deal just yet.
