While reading this Wired article how Wikileaks and it's owner are about to unleash the other shoe and how NO ONE IN THE WORLD CAN STOP HIM..
http://www.wired.com/threatlevel/2010/08/cyberwar-wikileaks/
Anyway,, this caused me to x-spend a few shards of my dwindling allotment of gray matter.
IF,, I say IF the following points are met:
The US warns Wikileaks and the world that releasing the names in the files could get someone killed
Wikileaks releases the remainder of the secret files
The Taliban (or other extremist) kill someone who's name is in the files
and a link can be made to 2 & 3
Can Mr Assange and his employees be convicted in the World Court of murder in the 1st, 2nd, or 3rd degree by complicity???
# 1 & 2 have happened, 3 will probably happen shortly, 4 is anyones guess..
A partial quote:
Crook v State Court of Appeals of Texas Feb 9 1889
Murder Accomplice Evidence Trial Verdict
1 A clause in an indictment stated that the defendants did unlawfully and with their express malice aforethought advise and encourage the said M to commit murder before M did kill B and did prepare and furnish the said M with a gun for the purpose of aiding and assisting the said M in killing and the said O and H defendants wore not present when the said M killed etc Held that the clause contained but a single count and sufficiently charged defendants as accomplices in murder
2 Under Pen Code Tex art 89 providing on trial of an accomplice the evidence must such as would have convicted the principal a detailed account of a confession of the principal admissible to prove the fact of the crime by principal but not to prove that defendant was accomplice or had any connection with the crime
3 The fact that a witness is a non resident the state does not prevent the admission in evidence of his testimony taken before the examining court which testimony is made admissible Code Crim Proc Tex art 774
.......
The form of the verdict was as follows: We the jury find the defendant Mack Crook guilty as an accomplice to murder of the first degree in the killing and murdering of James H Black as charged in the indictment and assess his punishment etc i
