I am hoping some of the keen Legal Minds can shed some light on this.

Charles Dryer known on YouTube as July4Patriot (http://www.youtube.com/watch?v=-e-6qh9Mnko&feature=related).

Mr. Dyer was apparently active in the Oathkeepers, American Resistance Movement and the Oklahoma Militia Movement.

In mid January of 2010 Mr. Dryer was arrested for the alleged rape and forcible sodomy of a child. During the search the sheriff’s deputies noted several firearms and a device believed to be a Colt M-203, 40-millimeter grenade launcher, a complaint was filed in the United States District Court of Western Oklahoma by Alcohol, Firearms and Tobacco Special.

The M203 had been stolen from Fort Irwin in 2006. According to several news sources including the well balanced SPLC (http://www.splcenter.org/blog/2010/01/22/oath-keepers-chief-denies-accused-rapist-was-member/)

Dyer told an FBI agent that his best friend had given him the grenade launcher while Dyer was stationed in California with the Marine Corps, according to court records.

Violation of Title 26, United States Code, Section 5871, referring to Section 5861(d), carries a maximum penalty of 10 years imprisonment and/or a $10,000 fine.

Then on April 13, 2010:

OKLAHOMA CITY — A jury in a federal courtroom Tuesday returned after several hours with a not guilty verdict for Charles Alan Dyer, who was charged in January with a federal complaint of possession of a grenade launcher.

Now my question is how could a jury find a person not guilty when the person was knowingly in possession of a unregistered NFA Device and knowingly in possession of stolen Military property?

I don't know if this has any bearing on weapons charge, but if convicted of the alleged rape of his 7 year old daughter...The crime is punishable by up to one year in jail or life in prison and a fine up to $10,000.

Defendant was in jail when cops searched his house. Cops were given consent to search by a roommate. No doubt, when asked by the police, roommate said the weapon was defendant's.

This is a pretty easy case for a defense attorney. Only questions to ask the police are 1) was defendant present when you searched, and 2) who was present when you searched.

Defense attorney gets up, puts the roommate on trial. States, rightly, defendant was in jail, roommate was at the house, must have been roommate's. Generally, to be hit with possession, the defendant must be in control, or at least have access, to the area where the contraband is found. Voila, reasonable doubt.

That is about as weak a case as you will see federal prosecutors bring. Federal prosecutors win about 90% of their trials, in part because the deck is really stacked in their favor.

I know I can't lend my legal NFA Device to anyone, it must be locked up, I must be on hand anytime it is used and I must have the paperwork in close proximity.....and there have been others who the BATFE pinched for far less infractions......So I was a bit perplexed and curious how a person with a unregistered and stolen military device could seemingly walk away.


Its simple. There was a resonable doubt. We were not there and did not hear the evidance. Remember he is INNOCENT until proven guilty. There are a lot of false accusations of child rape by former spouse or daughters of girlfriends that do not want some guy dating/married to their mom. As for the weapon charge we do not know the story there either. Was it stolen then rendered inoperable then sold to him? Remember he is aquitted of charges. Don't drink to koolaid from the media.

Up to one year for raping a 7 year old? That would be a crime.

Remember, he was found not guilty of the weapons charges in federal court. Sex charges are a state case, and are still pending.

I don't know of any state where a conviction of sexual assault on a 7 year old will only get a 1 year sentence.:confused:

That is what I read on several articles. But I also read in Oklahoma you can receive up to a Life Sentence depending on the severity of the sex crime.

It appears Dyers next court appearance is on May 25th, at which time the Court will decide whether allegations from the rabid ex-wife with a purported registered sex offender Uncle are true.

DUNCAN, Oklahoma -- An ex-marine and Oklahoma militia man sparks a nationwide manhunt. Law enforcement leaders say they're afraid he is heavily armed and will do something drastic.

Stephens County Sheriff Wayne McKinney says Charles Dyer didn't show up for court Monday morning on charges he raped a 7-year-old family member.

But Dyer's family says he is a constitutional patriot that's been hounded by the government and is now left with few options.

Online, Charles Dyer is known as July 4 Patriot. Thousands view his videos and anti-government messages.

Sheriff McKinney says in the past, Dyer and his followers have threatened him and other law enforcement, and it's that history that has him concerned.

"Desperate people do desperate things," Sheriff McKinney said.

Dyer's home burned to the ground on Friday. An acquaintance of Dyer has been arrested for arson. The sheriff says Dyer's firearms were taken from the property.

"We're sure he's going to be armed," said Sheriff McKinney. "There's no doubt about that,"

"I do not believe he's dangerous until he's shoved into a corner," Dyer's sister Amy Dark said.

Dyer's family says he is innocent. They gave News 9 a three page e-mail Dyer sent to his attorney just after Midnight Monday.

Dyer writes: "At every turn my family and I have been threatened and bullied by both the state and federal governments."

"I never had any intention of harming another human life and will still do all that I can to keep from it, but I also feel I have a god given right to protect myself and my family."

Dyer's family, however, says they just want what the sheriff does.

"I want it to end peacefully," Sheriff McKinney said.

Dyer ends his e-mail by telling his family if they do not hear from him within 90 days, he is dead and he failed them.

"If you see this Charlie, you need to come home," said Dark tearfully. "We want you to come home and finish the case."
