Body Believed to Be Missing California Teen Found

A body believed to be that of a missing 17-year-old California teen was found Tuesday afternoon, sources told Fox News.

Chelsea King disappeared Thursday from a wooded park in San Diego County.

King is a straight-A student at Poway High School who plays French horn for the San Diego Youth Symphony, competes on her school cross-country team and volunteers in a peer counseling program.

A sex offender suspected in the disappearance of Chelsea King was arrested Sunday in connection with her disappearance. He served only five years in prison for molesting a girl a decade ago after prosecutors rejected a psychiatrist's advice to seek a stiffer punishment, court documents state.

Prosecutors said in 2000 that John Albert Gardner III's lack of significant prior criminal record justified less than the maximum sentence for molesting a 13-year-old girl.

They also said they wanted to "spare the victim the trauma of testifying." {How about wanting to spare future victims?}

The San Diego Union-Tribune said Tuesday that Gardner had faced a maximum of nearly 11 years in prison under terms of his plea agreement. Prosecutors urged six years — the sentence later ordered by a judge.

In their 11-page sentencing memo, prosecutors said Gardner "never expressed one scintilla of remorse for his attack upon the victim" despite overwhelming evidence.

The girl was beaten before escaping from his home and running to a neighbor.

Psychiatrist Dr. Matthew Carroll wrote in sentencing documents, "There is no known treatment for an individual that sexually assaults girls and does not admit to it in any way." {There may not be a treatment, but there is a solution. For certain offenses, such as the one for which John Gardner was previously convicted , offenders receive mandatory life in prison with no chance of parole or the death sentence. Preferably, the death sentence.}

I personally suggest two 9mm rounds injected into the base of that man's skull. And at a few cents per round it'd save the country hundred of dollars per individual who received this treatment versus castration (chemical, surgical or garden tool-variety), lethal injection, the electric chair, or hanging (though this is pretty cheap too if you keep the rope).

Ever notice how the folks that create this situation don't have to live next to the scum? Prosecutors, Judges, Parole Boards? They all get a free pass and let the scum walk into someone else's life to ruin it.

As much as I believe in our constitution, and the right for every person to be tried fairly.....

when it comes to stuff against children I just want to bring back public executions...drawing/quartering, burning of the body parts.


We can give him a quick fair trial.... Then do exactly what you said above.

Kalifornia is far too lenient on serious offenders. These type of criminals are a heavy burden to the victims and also the tax payers. Some people should not exist.

ABC Evening News last night reported that there are "700,000" registered sex offenders in the United States,however their registrations are not kept up to date.....:mad: The police checked out some and found one that lived across the street from a school.... :rolleyes: They had one in here in Mississippi that was sentenced to 5 years,go out after 11 months,and was just arrested for doing the same thing again.....:(

Not keeping up to closely with this.... up to my eyeballs in schoool/reading again... but it seemed to me that the previous prosecutor asked for 10 yrs, got 6 and he served 5 of his sentence. A lot of it goes to sentencing guidelines and the judges discretion. Blame the judge, for handing down the lighter sentence, not the prosecutor.

SEE, I told ya I wasn't keep up to closely...but the judge still has discretion and had acess to the psych eval. I know, I got my ass chewed by Hizzoner in chambers yesterday for not mentioning it in my GAL recommendations.. wouldn't have changed my rec's but still... the judge has a lot of discretion in his sentence.

Hizzoner more than likely had the guys 'rap' sheet there in front of him. He had the prosecutors reccomendations and the abliity to see the psych eval if he chose.

Yeah the prosecutor still has some dirt on his/her hands. The end result still rests with the person doing the actual sentencing in my book.

In Tampa there is this judge, 'hanging harry". His fellow judges only allow him to hear first arraingements and misdemeanors because of his style and attitude. He has a well known and documented history of giving max sentences to 1st time offenders. He made a lot of money for the City of Tampa when he was a traffic judge. His fines were enourmous...lmao.. Unfortunately he is an elected judge, therefore getting him tossed out is not much of an option. He has been brought oup on ethics and complaints before the bar numerous times and always manages to skinny out the door law license in hand. :rolleyes:
The point I am making is that the final sentencing does rest on the shoulders of the judge doing the sentencing. The prosecution can ask or reccomend but in the end they are not the ones doing the sentencing.

Therein lay the rub. It is a catch 22 situation. Is it a one time situation or will he offend again. With no priors, its a crap shoot. However the simple fact that he is charged with that particular crime and statistics have shown that his sort does offend again and again and again. He should have not be put in prison but in a program for sex offenders.

Castration is not an option, this is not about testosterone. It is about a behavior. If it were about testosterone, I could conceivably argue that any male on this board is a potential molester. There are many more factors than simply having a pair of em. YMMV. My personal opinion is that someone like him needs to be removed from the planet period as quickly as possible. I would not waste a bullet on him though, that would be wasting too much money and bullet abuse.. a quick knife to the jugular, let him bleed out and walk away. MOO ....Shrug...........:mad:

Couldn't agree more, the recidivism rate for sexual offenders especially molesters is ridiculous, IMO there is no way to protect society and our young without removing these predators from the herd..

Teddy darlin' you could never make me mad at you...no way.... but bleeding out is painless and it takes minimal time. Besides trash like that is not worth the cost of a bullet/electricity/drugs. :mad::mad:

Edited to add: I am NOT a lawyer. In Fla one can be a volunteer GAL. I took the course in 1996 because I strongly believe that children need a nuetral voice in court. It is part and parcel of my beliefs that its the only right thing to do to give a voice to those who have none in our legal system.

The problem that lies with this number is how many are actual sex offenders? I agree wholeheartedly with everything that is said about the people that are out there molesting kids. My father's advice for judgement in these cases is take them to an old deserted building, nails their penis to a wooden object, give them an old rusty knife, set the place on fire, and give them the choice on whether they are going to live or die.

The problem with the sex offenders registry, as I see it, is you have kids in there that have to register because the 19 year old boyfriend was having consentual sex with the 17 year old girlfriend, her parnets got pissed and had him arrested for statutory rape. These folks are mixed in with the true pedophiles that need to be drawn and quartered.

Until the justice system can find a way of truly classifying, and hanging the folks that really deserve it, and find another way to deal with the folks that are involved with the example above, we will continue to have these problems.

Turns out a repeat offender in his 60s with a predilection for younger teenage boys lives across the street from my mom, and only a few hundred yards from an all-boys reform school. The authorities don't seem to care about his proximity, but the neighborhood keeps a tight watch on his every move.

Then again, this is the same area where two judges were indicted last summer in a "kids-for-cash" kickback scheme. They allegedly accepted more than $2.5 million in kickbacks for sending juveniles to two private, for-profit detention facilities.

Good thing I had some great parents watching out for me and my brother in our younger years, as it seems other adults don't seem to do the same.

Ha! My wife's reaction? She checks the online listing every so often and a while back found out one moved in one street over. She printed out the sheet and went house to house throughout the neighborhood passing it out. Neighbors thanked her and the dude moved out shortly.

A thought or two. Hormones do play a part, but not the whole part. History is very likely to decide the impact of hormones on behavior. That having been said, history decides the hormone driven behavior; not always sexual.....hence repeat offenders. In general the sexual abuser was also abused at a very early age, with no way to resolve the trauma. That dictates how the abused will respond to make him/herself feel comfortable; this is not a pure male event. IMHO, the abused looks for punishment for the abuser by abusing another innocent, a transfer of pain that will not go away...."and so it goes".

It is very clear that we have yet to find an answer to the problem of sexual abuse. Long and criminally short incarceration is not working. Psych intervention is not working very well....so what is the answer?

One of my thoughts has been to, in the male, remove the offending appendage and leave the testes.....frustration!! But then, the perp would just find another way to abuse; Lord I hate this in "man":mad:.

How do you think the neighborhood found out about his previous activities? :D She makes sure to keep him on a short leash, and readily informs him that she has a baseball bat behind her front door. No matter how old I get, I always try to stay on her good side. ;)

It sounds good on paper, but you have to realize that being able to "hold them accountable" would impossibly tie up the judicial system that's already overloaded. Every man or woman who felt like they got a raw deal in a lawsuit or custody battle would sue the judge and/or prosecutor. (Not that I'm saying they didn't completely screw up on this one.)

That's true. But, there is professional review of professional standards, not to mention many states either elect or confirm their judges by voting. Judges who let heinous criminals off with a comparative slap on the wrist need to be removed at the earliest chance offered by that state's constitution. We can no longer stand for this. The loss of life, even one, is too much.

The sorry fact is the system as such does not allow itself to be fixed quickly if at all in some cases. Until that changes, we must raise our children with a healthy dose of caution and stay aware of our surroundings. The Beast is out there and its always hungry. Google Anna Svidersky. Look up Enrique Almendarez in SC. Used to put him in jail every time I saw him on the street (kinda hard to register an address when you're homeless, makes for an easy warrant :D, and then there's always the Public Disorderly catchall) til he decided to move out of my county. And yes, I notified them over there to keep a look out for the POS. All told he's done about three and a half years for my arrests, which according to him is almost half of what he did for the original charges.
Point is, his offenses occured in two other states before he moved down here and became my target. Wouldn't have known he existed until he showed up at a playground and asked a dope dealer's 6 year old neice for a lap dance. Still can't figure out why he isn't dead.
These people are everywhere, free to roam until they spit on the sidewalk, a cop runs them, and finds out the Beast snuck into your town, and even then he may be powerless to do more than document the situation.

I think Richard summed it up.

Not every victim is willing or able to testify. Until a girl is killed, the punishment just doesn't cut it. I am not a fan of the death penalty (just puts us in odd company in the world for a small number of people who can also rot in jail) but a 9mm to the base of the skull solution works for me. Rapists repeat and at least from personal experience, escalate. This one has no happy ending that I can see.

San Diego County Sheriff Michael Gore said that human skeletal remains found in the area of Pala -- a rural area in East County, California -- have been positively identified as those of DuBois.

Dubois last seen walking alone to school on February 13, 2009.

QP alright4u makes a good point about castration for male pedophiles IMHO.

Surgical castration upon conviction and chemical castration follow-ups to monitor hormone levels if/when the pedo's released makes me feel safer for the children, rather than therapeutic treatment, aiming to curb their hard wired predatory instincts.

Even if Gardner served the full 11 years wouldn't he still be a threat upon release?

Mandating the death penalty for molestation may backfire because it often precludes the offenders from having charges pressed against them when they are family members, "friends" of the family, "esteemed" members of the community, ect.

The offender should be made to pay the cost of their medical treatment and repeat offenders not given another chance. RIP Chelsea King and Amber DuBois.

Friday, John Gardner pleaded guilty to murdering teenagers Chelsea King and Amber Dubois.

According to the La Jolla Light, Gardner entered into a plea deal, which spares him from the death penalty. However, he is expected to be sentence to two consecutive life terms with the possibility of parole.

Chelsea, 17, disappeared Feb. 25 after heading out for a jog near Lake Hodges. Her body was found just days later in a shallow grave near the lake. Gardner’s DNA was found on Chelsea’s underwear.

Amber, 14, vanished in Feb. 2009 while walking to school. Her skeletal remains were found in early March—just miles from where Chelsea was discovered.

Gardner also faces 33 years to life in prison for attacking a woman in December.

His guilty plea regarding Chelsea and Amber bars him from appealing his conviction and sentence in the case, according to the La Jolla Light.

Gardner has a history of violence with underage girls and in 2000 was sentenced to six years behind bars after pleading guilty to assaulting a 13-year-old girl. He ultimately served just five years.
