CAIR is attempting to crush Christmas for Rifqa. They have gone to court to extinguish the Atlas Christmas card campaign. Here is the back story: CAIR Attorney Demands Ban and Seizure of all Christmas Cards sent to Rifqa Bary.
What follows is an adaptation of the text of CAIR attorney Omar Tarazi's motion to ban and seize all of Rifqa's Christmas cards. You can find the text of his actual motion here. The motion was filed with the Franklin County Court of Common Pleas on December 1st at 11:29am. Tarazi represents these lovely nurturing parental units, the Barys.
Atlas reader Dr. Greg has confirmed the filing and came up with this delicious idea:
I have confirmed the filing of the motion to enjoin counsel etc. by Omar Tazazi ,through Maryellen O'Shaughnessy, the Clerk Of Courts for Franklin County-614-462-4633.;it is a dirty, mud-slinging piece of slime.
However, since the motion includes :"third Parties" ie, those who have sent Christmas cards to Rifqa or will,the legal possibility exists that said "third parties" are now part of the case and can file motions with the court calling for the rejection of this injunction and other matters. This will not require an attorney since the "third parties "can now act for themselves directly since they have been made parties to the case. This is called "Pro se"(by myself). Just copy the general form Omar used, change the words, and mail it to the correct address which can be found somewhere on the Franklin County Court of Common pleas.
Ultimately it is up to the judge to decide, but the more filings the merrier.And let the media see them. Then there are appeals.
Of course, one can "allege" practically anything no matter how outrageous in a motion, as Omar has so scatologically done. Well, turn the tables on this: anti-freedom, terrorist- linked, fifth-column, tyranny-loving, sharia-pushing, hate-mongering, self appointed censor and First Amendment destroyer; you get the idea. We might even subpoena victims of the practitioners of sharia incidents such as Hussein Hajji Wario, who has volunteered to testify in Ohio, and others. Herbert I. London , president of the Hudson Institute, has written an open letter about Rifqa's case. Perhaps he would present it to the court. I don't know if he has sent a Christmas card or not. Perhaps you, or one of your contacts could ask him for a degree of involvement. Like you, he also wrote an article on D-Day at Normandy, on the necessity of all out direct conflict to defeat evil.

Wherefore, now comes Fathima Rifqa Bary, by and through counsel, Kourt Gatterdam, and move the Court to enjoin Mohamed Bary and Aysha Risana Bary’s attorneys from impeding delivery of messages of third parties directly to the minor child without the approval and supervision of Franklin County Children Services; Petitioner moves the court to order Mohamed Bary and Aysha Risana Bary’s attorneys to turn over all such communications in their possession or control to Fathima Rifqa Bary; that third party adults shall be allowed unrestricted access to communicate with Fathima Rifqa Bary, as she has committed no crime and is not a prisoner.
MEMORANDUM IN SUPPORT
1- The Council on American-Islamic Relations, which has been named by the Justice Department an unindicted co-conspirator in a Hamas terror funding case, through the attorney Omar Tarazi is attempting to impede delivery of Christmas cards to Fathima Rifqa Bary at her attorney Angela Lloyd’s, and to impound those cards.
2- CAIR, the Council on American-Islamic Relations, is an unindicted co-conspirator in the Holy Land Foundation Hamas terror financing case. CAIR operatives have repeatedly refused to denounce Hamas and Hizballah as terrorist groups. Several former CAIR officials have been convicted of various crimes related to jihad terror. CAIR’s cofounder and longtime Board chairman (Omar Ahmad), as well as its chief spokesman (Ibrahim Hooper), have made Islamic supremacist statements about the Koran and Islamic law ultimately replacing the U.S. Constitution and system of government. CAIR is currently under investigation by the FBI.
3- Allowing such an unsavory and dishonest organization to infringe upon Fathima Rifqa Bary’s right to communicate with whomever she wishes to communicate is dangerous to her health and safety. It also undermines the ability of Franklin County Children Services to do its job in supervising and protecting Fathima Rifqa Bary. The GAL for Fathima Rifqa Bary, FCCS and the parents of the minor child have a responsibility to ensure that Fathima Rifqa Bary’s rights are protected, particularly when the third parties might endanger the health and safety of the minor child.
4- Therefore, for the safety and security of Fathima Rifqa Bary we ask the court to enjoin Mohamed Bary and Aysha Risana Bary’s attorneys from impeding delivery of any and all messages sent to Fathima Rifqa Bary, and from impounding such communications. All such messages that may be in their possession or control should be, by order of the court, turned over immediately to Fathima Rifqa Bary; as Fathima Rifqa Bary is not a prisoner and has committed no crime, no restrictions should be placed upon her associations or communications, and those who try to impose such restrictions in the future should be held in contempt of court.

Our Christmas card campaign of support for Rifqa Bary has made the jihadists in America very angry. Un-indicted co-conspirator, Muslim Brotherhood front CAIR is demanding the cards be seized. This is simply the age old Islamic persecution of Christians.
I never imagined they would take such an evil action, but it shows us who and what they are.
Forces of evil cannot stop such goodness.
This cannot stand in America. Though I am glad we were so successful. There must be thousands of cards, if CAIR is twitching like this.
