Orchard Park police are investigating a particularly gruesome killing, the beheading of a woman, after her husband -- an influential member of the local Muslim community -- reported her death to police Thursday.

I thought second degree was a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility.

If I hit you in the head with a lead pipe because we are fighting over cheating at cards then the assault with a lead pipe had the distinct possibility of resulting in death.

Acting either alone or with one or more other persons, he commits or attempts to commit robbery, burglary, kidnapping, arson, rape in the first degree, criminal sexual act in the first degree, sexual abuse in the first degree, aggravated sexual abuse, escape in the first degree, or escape in the second degree, and, in the course of and in furtherance of such crime or of immediate flight therefrom, he, or another participant, if there be any, causes the death of a person other than one of the participants; except that in any prosecution under this subdivision, in which the defendant was not the only participant in the underlying crime, it is an affirmative defense that the defendant:
(a) Did not commit the homicidal act or in any way solicit, request, command, importune, cause or aid the commission thereof; and
(b) Was not armed with a deadly weapon, or any instrument, article or substance readily capable of causing death or serious physical injury and of a sort not ordinarily carried in public places by law-abiding persons; and
(c) Had no reasonable ground to believe that any other
participant was armed with such a weapon, instrument, article or substance; and
(d) Had no reasonable ground to believe that any other participant intended to engage in conduct likely to result in death or serious physical injury; or

The knife must have slipped, no peace loving muslim I know would ever actually chop off his wife's head. Prominent Orchard Park man charged with beheading his wife

Orchard Park police are investigating a particularly gruesome killing, the beheading of a woman, after her husband — an influential member of the local Muslim community — reported her death to police Thursday.
Police identified the victim as Aasiya Z. Hassan, 37. Detectives have charged her husband, Muzzammil Hassan, 44, with second-degree murder.
"He came to the police station at 6:20 p.m. [Thursday] and told us that she was dead," Orchard Park Police Chief Andrew Benz said late this morning.
Muzzammil Hassan told police that his wife was at his business, Bridges TV, on Thorn Avenue in the village. Officers went to that location and discovered her body.
Muzzammil Hassan is the founder and chief executive officer of Bridges TV, which he launched in 2004, amid hopes that it would help portray Muslims in a more positive light.
The killing apparently occurred some time late Thursday afternoon. Detectives still are looking for the murder weapon.
"Obviously, this is the worst form of domestic violence possible," Erie County District Attorney Frank A. Sedita III said today.
Authorities say Aasiya Hassan recently had filed for divorce from her husband.
"She had an order of protection that had him out of the home as of Friday the 6th [of February]," Benz said.
Muzzammil Hassan was arraigned before Village Justice Deborah Chimes and sent to the Erie County Holding Center.

I think religion may not have much to do with it...other than this couple just happens to be Muslim. Husbands/wives, boyfriends/girlfriends, parents/children, brothers/sisters, neighbors kill each other all the time for all kinds of reasons...regardless of religious belief or lack of it.

I saw that, too, but it didn't state why and as it was related to a 'divorce' and all that can go along with such things, I did not assume it meant violence--it could just be to keep him off the property so he couldn't take things of value, keep him away from the kids out of spite...or whatever. Guess I spent too much time as a Board Recorder for Admn Discharge Boards, applying UCMJ as a Company Commander, working International Agreements at the TAACOM...and watching too many episodes of Boston Legal. ;)

Maybe I am way off base here, but an "order" is filed to "protect" an individual that believes another individual will do them harm.
Since in the end, he cut off her head...it leads me to believe that it was an order to protect her from violence.:confused:

JMHO...but an assumption of 'prior violence' may be putting the cart before the proverbial horse with the 'facts' given in the news article. OTOH...the protection order may--in fact--be for previous violence...but a charge of 2nd degree murder makes me wonder.

After leaving, the man threatens the woman verbally again and again, until she wisely, or not-so-wisely decides to go to the authorities she did not go to after the attack, and seek an order of protection.
(Which is paramount to, "Hey Lady, you shouldn't have been with this maniac to begin with...and you are coming to us now?")
Okay, fine. The Lady makes her own choices and lives with them.

My first instincts was to agree with you so I looked up the NY state statutes for both Murder 1 and Murder 2,
Here is the murder 1 statute;

I'm not going to post the whole statute as it's really long. The crux is to prove murder 1 in NY it would appear you have to kill a LEO or Judge, or kill a person who testified against you in criminal court, or one of said witnesses family, or kill someone while in the commission of another violent crime like burglary, or if one had already been convicted of murder, or killed multiple people in one setting, and it goes on....the only portion of the statute that might apply to this case based on the very limited info that we have thus far is this;
or
(x) the defendant acted in an especially cruel and wanton manner
pursuant to a course of conduct intended to inflict and inflicting
torture upon the victim prior to the victim's death. As used in this
subparagraph, "torture" means the intentional and depraved infliction of
extreme physical pain; "depraved" means the defendant relished the
infliction of extreme physical pain upon the victim evidencing
debasement or perversion or that the defendant evidenced a sense of
pleasure in the infliction of extreme physical pain;
I don't know if the above would fit the crime, it would be highly dependent on the facts, specifically how and when he cut her head off, if she was already dead when he did it etc. The defense could argue that while the defendant’s behavior was gruesome and egregious it doesn't meet the intention of the above statute if the victim was already dead.
In any case it would appear to me that this isn't a case of a prosecuter being PC but rather simply the way the NY statutes are written, of course I'm not a lawyer if any of our resident counsels have a different view I'd like to hear their thoughts on the matter.

Just asking, but are beheadings common in western New York? I used to spend a lot of time in that neck of the woods and I don't remember decapitation as a routine form of murder. Yet the killing of Aasiya Hassan seems to have elicited a very muted response.
When poor Mrs Hassan's husband launched his TV network to counter negative stereotypes of Muslims, he had no difficulty generating column inches, as far afield as The Columbus Dispatch, The Detroit Free Press, The San Jose Mercury News, Variety, NBC News, the Voice of America and the Canadian Press. The Rochester Democrat & Chronicle put the couple on the front page under the headline "Infant TV Network Unveils The Face Of Muslim News".
But, when Muzzammil Hassan kills his wife and "the face of Muslim news" is unveiled rather more literally, detached from her corpse at his TV studios, it's all he can do to make the local press - page 26 of Newsday, plus The Buffalo News, and a very oddly angled piece in the usually gung-ho New York Post, "Buffalo Beheading: Money Woe Spurred Slay".
Oh, really? He beheaded her for some goofy clause in the insurance policy? Not exactly:

Well, maybe. But for sheer news value you'd think this one might stand out. Look at this picture. That's the very definition of "moderate Muslim". Look at the late Aasiya Hassan, beautifully coiffed, glossy-lipped. On countless occasions since 9/11, I've found myself at lunch or dinner in New York, London, Washington, Paris or some other western city, sitting next to a modern Muslim woman like Mrs Hassan telling me how horrified she is at how hijabs and burqas, honor killings and genital mutilation, forced cousin marriages and the disproportionate number of Muslim wives in European battered women's shelters, how all these have come to define Muslim womanhood in the 21st century. Yet Aasiya Hassan ended up no differently - all because her husband's TV network had a cashflow problem?
The media's lack of curiosity is in marked contrast to their willingness to propagandize for the launch of Mr Hassan's station. It also helps explain why the US newspaper business is dying."

This is the first time I can recall an MSM outlet calling a killing such as this an honor killing. There is the case of Amina and Sarah Said, killed by their father in the DFW area. But, the MSM just reported that the FBI had included that some had called their murder an 'honor killing' on the wanted poster of their father.

Chesler, who wrote "Are Honor Killings Simply Domestic Violence?" for Middle East Quarterly, said some Muslim men consider divorce a dishonor on their family.
"This is not permitted in their culture," said Chesler, whose study analyzed more than 50 reports of honor killings in North America and Europe. "This is, from a cultural point of view, an honor killing."
Chesler said honor killings typically are Muslim-on-Muslim crimes and largely involve teenage daughters, young women and, to a lesser extent, wives.

I first read the story on FoxNews.com and then Jihad Watch. I don't bother reading the MSM (and most of you know why.."why bother"). And the MSM won't make an issue that he is a muslim.
IMO, I think the law is and will be handling this in a PC manner for several reasons:
1. He is a muslim
2. They fear of being called racist if they are not sensitive to the fact he is a muslim and his honor is at stake (ie, she received an order of protection against him and filed for divorce)
3. They fear of stirring up the masses of muslims (and I fear, regardless, it will stir them up)
4. His counsel may look to sharia law for his rights as a husband and muslim man (DO NOT be surprised if this happens...I will be surprised if IT DOESN'T!).
5. We can see this for what it is, "honor killing" but the law and the press tread lightly and in PC fashion and will undoubtedly work hard to keep that term out of any reporting/court filings.
Having been an LEO and having lived in NY, I have seen the theater of the absurd that charades itself as the legal system there. If that man had been a white, Christian who beheaded his muslim wife....oh you can bet your kidneys to the bank...he would be receiving a First Degree Murder charge! And muslims would be up in arms around the world!
I do not care if this woman was a muslim or if she was a crackhead from a trailer park....she deserved to be protected, regardless of race, religion or age. I know people do spiteful things when they get seperated/divorced, but who is to say that she didn't really and desperately NEED the protection! She may have known what was in store for her and asked for the protection order before she served him with divorce papers. BUT this is just another sign that THEY are not peace loving and its all about the honor of a man in their religion! Their hypocrisy knows no boundaries and they are shameless in it.
The fact that women's groups and other agencies are NOT up in arms about this, really chaps my female hide! IF nobody speaks out for the rights of victims, especially in something this heinous, we are truly lost!!! It will become the norm.... and more cases like:

DA's probably thought they would have a hard time establishing it without reasonable doubt.
It's aggravating for me to think about him not getting the death penalty - but not compared to the law governing domestic conflict in some Middle East countries.

I do not care if this woman was a muslim or if she was a crackhead from a trailer park....she deserved to be protected, regardless of race, religion or age. I know people do spiteful things when they get seperated/divorced, but who is to say that she didn't really and desperately NEED the protection! She may have known what was in store for her and asked for the protection order before she served him with divorce papers. BUT this is just another sign that THEY are not peace loving and its all about the honor of a man in their religion! Their hypocrisy knows no boundaries and they are shameless in it.
The fact that women's groups and other agencies are NOT up in arms about this, really chaps my female hide! IF nobody speaks out for the rights of victims, especially in something this heinous, we are truly lost!!! It will become the norm.... and more cases like:
Abuse of women (and children) hits really close to home for me and while I was able to be objective and emotionally removed from it while I was an LEO, in my personal views and life...I won't! So I apologize for the rant... :mad: :mad:

Unfortunately, IMMHO, I believe we have become a society that tolerates violence toward women, as a matter of fact, we almost advocate it. By we, I do not mean those of us (like most on this forum) that have high standards, morals, ethics and principles but the "WE" of Society. Look at music, fashion, TV, movies, the gangbanger problem in this country. And now the creeping, infilitrating, cockroach-like infestation of the muslim religion and laws that advocates it so strongly. SF-TX had posted a comment on how long it took the FBI to "rather reluctantly" call the killing of those two young girls, an honor killing. I doubt that this murder will get that label, it just wouldnt be politically correct.
I think that we have become so desensitized toward this violence that people hardly bat an eyelash at it. When I hear comments like "well, she probably deserved it for what she said to him; besides nobody liked her anyway, she's a b*%ch!" (this was overheard after a discussion of an assault on a female) and some were even overheard laughing about the assault. And the scurge (I refuse to call them human) that were commenting about her, were of mixed ages. It was sad and sickening. That people would joke about the vicious assault on a female? What has happened to humanity?
You know what is scarry is when you do a google search you get more hits on horse+abuse+cases (8,780,000 hits) vice wife+abuse+cases (3,030,000 hits)
Guess they are procesucating more of them than domestic cases... Just an odd relation......... Must come from our old western roots.

BUT seriously, it still is under-reported by victims. The amount of shame that a victim carries with them can be crippling in many ways. There has been a rise in men reporting abuse by a female but not to the extent of male on female abuse/assault.

Hollis, I agree with you. It seems that even in this day and age, if a woman is strong, independent and has an opinion she is either a lesbian or a b*&ch! I am one of those strong women and am constantly told I am intimidating. <shrug> I don't get it. I was really shocked at how the D's treated Gov. Palin. But then again, it shows you how threatened they are. However, that subject is a digression.
Out of curiosity, I went to the National Organization of Women website just to see what they had on abuse of muslim women. NOTHING! Am I shocked, no! I was never a member of their organization (gag) but had a cousin who was for years and was even a well respected, active leader in it for years. She used to try to recruit me quite heavily (when I was LEO especially) but when I asked why they were not more proactive and LOUD about combating the abuse of women, she said it was funding and politics. What I got out of that discourse was that there were a lot of women as members but they were armchair crusaders and unless the money was there, the press was on hand and they weren't doing anything that was politically incorrect, it was ok to go out and demonstrate for the rights of women. Not to mention the leftist liberal leanings they had....I couldn't be bothered with them. And alas, you don't hear (and you won't) them screaming for victims rights in this case either.

Unfortunately in my AO I would argue we already are a society that tolerates violence against women and mostly due to the piss poor judges in SC (one of the main reasons I'm now x-LE). Our state law allows the LEO to be the complainant in a criminal trial against a person for Criminal Domestic Violence (CDV), yet all of the judges I ever went before refused to actually hear the case if the victim was either not there, or came in with the abuser, and any LEO who's studied/worked CDVs knows that in many cases there is a cycle of abuse that goes on, and the week or so after the abuse (when the case was usually heard in our case) the abuser and the victim had usually found their way back to the honeymoon stage of the cycle or the victim was still too afraid of the abuser to show up, either way the charges don't stick and the cycle continues until the victim eventually gets enough (rarely happens) or the victim gets killed (happens more often than it should).
Also in SC the penalty for CDV 1 is next to nothing normally they got anger management and a fine, the law doesn't really get teeth until you hit CDV 3rd, (which most the abusers would be to in less than 6 months if they were actually prosecuted according to state law). I really hope it's not as bad in the rest of the country, but I fear it probably is.
So while I would love to say we're doing well (and we are when compared to many other countries) we still have a long way to go.
Either way this guy should get to ride the lighting for his crimes against that poor woman, there is no excuse, though I'm sure he'll claim he wasn't in his "right" mind or he wasn't hugged enough or whatever bullS*(& his lawyer can come up with to get him off.

As this religion of peace thread continues, here is another interesting tidbit. I was watching CNN yesterday (I know - - I should be watching FOX) and there was a news story about a gal, I think she was Iranian and this happened in Terhan. Anyway, some guy was head over heels in love with her and asked her to marry him, where she said no. He asked her again and the answer was the same . . . a nice big NO! And the gals answer is the same as the two previous times, "I tell you three times NO !! " Well, how does our Muslim stud muffin handle the three rejections by the apple of his eye ? Does he try harder, take her out, dinner and a movie???? No !! He decides to THROW ACID in her face, where she is now blind and permanently disfigured !! Now, he is in jail/prison and she wants his punishment to be "an eye for an eye" and if he is found guilty, she wants his two eyes plucked out as punishment.
Just a cute little human interest story I thought I would pass along.

In the case I cited from California 1999, the LE's knew the judge at the "hearing" for the protective order. This is why they asked the woman if she went to a hospital for treatment after her attack by the fiance. She did not.
The judge had a courtroom consisting of the fiance + attorneys on one side, and the gal on the other. Long-story short, she repeated the details of the attack, and the threats made towards her after she left.
The judge decided there was not enough evidence to put the order to permenant status.
In this case, the judge just let an offender off the hook to go do it to someone else, IMHO.

I think this is common notion in many older societies. The Native Americans in the Mid-West would aggressively destroy their enemies after a battle. I'm all for bringing back public executions. Hang or shoot a bunch of these turds (I'm talking scum of the earth that are on death row) in the town square and it will do wonders to deter crime. It not at least the family will get the satisfaction of seeing these scum bags go down.
