A Bronx soldier who hired a hit man to shoot him in the leg so he wouldn't have to go back to Iraq was sentenced to a year in jail yesterday after admitting he lied about being in combat and witnessing atrocities.
For months, Jonathan Aponte detailed the horrors he'd seen in combat, talking of the smell of burning flesh, the sound of car bombs and the horror of "being shot at every day" by insurgents.
The 20-year-old's story garnered him sympathy nationwide and he was invited on the Star Jones show to pour out his heart.
In a stunning reversal, prosecutors said yesterday it was all made up: Aponte worked in a warehouse during his Iraq tour and never saw combat.

I was on a domestic violence call the other day, and the suspect started talking about being prior military. Turns out he did a tour in Iraq, and was slated to go back (he was an active duty bradley gunner) when he decided that he wanted out. "F*ck that sh*t" were his exact words...
So he tried to get a medical for PTSD..... when that didn't work, he decided to try the "hearing loss" angle. He straight up said, "they put you in a booth and tells you to push a button when you be hearing something........ I just didn't push the mo'f*ckin' button." He was proud of it.
He got out, and apparently got a 20 percent disability rating for hearing loss.
He now works as a firefighter for our fine city, and had been fighting with his baby's mother over the fact that he had failed his EMT exam for the third time (new firefighters have 4 chances to pass it within their first year, or they are let go). Most pass it while still in the academy......

Not very smart to admit his fraudulent claim for VA benefits. Not to mention that someone that badly needs and deserves them is still awaiting eligibility clearance.

I make the assumption that you are a law enforcement officer of the highest caliber. Is there any way you could turn that sorry punk in to the VA? Because he is stealing money from you and me and all other taxpayers. He will continue to steal money until he dies. Thing is, he IS STEALING!!!! He did not earn those benefits, he is stealing them. This guy confessed to committing a crime to you and he is still committing the crime. I wonder if you could end it.

I just spoke with the Lt of the our county PD who's doing some work on one of my AR15's. He too is a reservist with two tours in Iraq under his belt. I brought up the subject matter at hand and he was shocked, pissed might be the more appropriate word.
He told me exactly the procedures he would take if he had witnessed such a foolish confession of fraudiently making false claims for VA medical benefits.
I also took a hearing exam some years ago with VA medical center. It was in my end of service medical records taken at the time I was clearing for ETS that I had lossed 30% of my hearing in my right ear. However, I heard each "Ping" in the hearing booth and therefore pressed the buttom to exact a response.
There's enough guilt in life, even when you walk the straight and narrow, to keep you up some nights. I'd have an even bigger problem If I'd lied to the VA when some soldier is sitting behind me as a double amputee from the GWOT.
I'm not perfect, but that's just me.

Likewise. One of the guys from my old unit is now working in the auditing department of the VA in Oklahoma. I'm sure he'd be happy to help out or point you in the right direction. Let's save the VA dollars for those that need it.

I may be wrong, but IIRC, hearing loss carries no direct compensation, beyond entitling the veteran to free hearing aids.
It may be a line item but does not necessarily add anything to the bottom line for disability income.

When I was ETSing we were informed that the military does not pay out compensation for hearing loss unless you're deaf or damn near it. However he might have hustled himself through during a high turnover post deployment... or made even bigger false claims at the VA....

I think you are right. But I can't stand the fact that there are guys out there that get over on the system. You don't even want to know what I think we should do with these types. Handcuffed to the hood of a Hummer for one or two tours would be a good start. I could go on, but it may hurt my later bid for public office.

I was an MP in the Army 20 years held positions in field, Garrison, as and MP on the road the I was also a desk Sgt and a operations. Anyway the point is that SPONTANEOUS STATEMENTS ARE ADMISSIBLE IN COURT, that would also include military or civilian, also your police notebook in admissible in court. I suggest you make and entry in you police notebook for that date and that incident.
You are right about hearing loss but they do give disability for tinnitus. I also believe that it is a crime to use the VA when other people who have lived through the causalities of war deserve it more. I wish you luck with your endeavors and hope you are able to right this injustice. :munchin

Currently I have been told that hearing loss over 30% will receive a rating however the most that you can get for it will be between 0-10% per ear, so no more than 20% total, which is enough for monetary compensation and vocational rehab.
When I went through the VA in 2004, I was told that hearing loss can be rated through the VA but only at 0%. This would entitle the individual to health care specific to that disability only and no monetary compensation.
Its been my experience that what gets submitted for a rating will vary from office to office. Its also seems to depend on whether or not you get an advocate from the DAV or local Veterans Administration to help you handle your case. Also how persistant you are is a huge factor.
This is just based on my limited personal exeprience. I do not mean to contradict anyone who may have more authority on the subject than I do so please do not take this as cannon. Again, its just what I have been told recently my friends that work for the VA.
From what I currently understand, the sh*tbag in question is not receiving any money for his hearing "loss." None.
I'm still looking into this, genlemen.
