A letter written by a Capitol Police officer to Acting Chief Christopher McGaffin said Kennedy appeared to be staggering when he left the vehicle after the crash about 3 a.m. The letter was first reported by Roll Call, a Capitol Hill newspaper.
Kennedy said he was late for a vote, officer Greg Baird said in the letter to McGaffin. Baird is acting chairman of the Capitol Hill chapter of the FOP police union. The last vote of the night had occurred almost six hours earlier.

Yeah, every time I take a Meclizine tab, I have the irresistable urge to speed about with my lights off at 0300, crash, stagger around, then shout non-sensical BS about being enroute to an emergency vote, till my paid cops get me out without even so much as a field sobriety test.

Bet he shows up in rehab in the next 30 days and nothing comes of the DUI traffic accident. And the great people of his state return him for another term.

The get of jail free card - They all got the on the HILL. Them, wives/husbands, kids, Class - D dependents maybe?? I've seen it while station in Alaska. A wives on "vacation" was speeding on Ft Rich, then that night Drunk driving downtown.
Damn, now it's anti-nausea med AND Ambien! So in addition to doing laundry and eating while sleeping, it makes your breath smell like alcohol and causes you to crash your car!

In addition, NO ONE performed any FSTs... good luck with even getting a charge... not that they would push for it.
Things like this happened a few times while I worked at the SO before getting in the Army with the same result: sh*t bag gets off scott free, while the officer (who was just doing his job) that stopped him was asked not to come back to work.

Sir, I refer to this phenomenon as the "shit factor". You can shoot shit, stab shit, strangle shit, beat shit, crash into shit, and it WILL NOT DIE!
In PA (and I assume other states) there is a statue which covers driving under the influence of an intoxicationg SUBSTANCE. It does not need to be alcohol or illegal street drugs. You can be charged if you take too many over the counter drugs and you are impaired. You need a blood sample for evidence and the standard sobriety tests. Unless they get his blood..he will walk... err stagger away.

DC news radio was quoting a cop yesterday who described Kennedy as "stinking drunk." Just as well he stayed on land, Massachusetts isn't the only area with Indian-named rivers.
People like this need to be elected to stay in power - how do they pull antics like this and still maintain a political aristocracy? :confused: :mad:

No kidding. I'm no LEO or lawyer, but it sounded a lot like battery to me. But she's elected, she's "in the club," so she can rant and assault others for "racism" while she's personally inviolate. We need term limits to force these people out and fresh blood in.

WASHINGTON -U.S. Rep. Patrick Kennedy insisted yesterday that he had consumed “no alcohol” before he slammed his Mustang convertible into a concrete barrier near his office, but a hostess at a popular Capitol Hill watering hole told the Herald she saw him drinking in the hours before the crash.
“He was drinking a little bit,” said the woman, who works at the Hawk & Dove and would not give her name.
Leaving his office late last night, Kennedy refused to say whether he’d been to the Hawk & Dove the night before.
Earlier in the evening, Kennedy issued a statement through his office blaming the accident and strange behavior surrounding it on prescription drugs.
He said he returned to his Capitol Hill home on Wednesday evening after House votes and took “prescribed” amounts of Phenergan and Ambien.
Phenergan is for gastroenteritis, he said. Ambien is a popular sleep medication.
“Sometime around 2:45 a.m., I drove the few blocks to the Capitol Complex believing I needed to vote,” his second statement said. “Apparently, I was disoriented from the medication.”
Questions arose surrounding the wreck amid police reports that Kennedy was “staggering” and appeared intoxicated after nearly hitting a Capitol Police cruiser and then striking the barrier.
The incident became public when the union representing Capitol Police alleged in a publicly released letter that superior officers prevented rank-and-file cops from properly investigating the crash.
The letter from the cops union said police spotted Kennedy’s Mustang swerving with its lights off. The car narrowly missed a cruiser before slamming into a security barricade, according to the letter written by officer Chris Baird, chairman of the department’s union.
The driver exited the vehicle and he was observed to be staggering, Baird’s letter states. The letter also said that Kennedy claimed he was“late to a vote.” The last House vote was taken nearly six hours earlier.
Patrolmen’s union president Lou Cannon told the Associated Press that officers were fuming that police brass intervened and blocked attempts to give Kennedy sobriety tests. “The officers just want to be able to do their jobs,” Cannon said.
Leaving his Capitol Hill office last night, Kennedy told reporters: “I asked for no special treatment.”
After Kennedy responded to the swelling scandal with his first letter, a Herald reporter visisted bars where Kennedy is known to socialize.
A bartender at the Tune Inn, which is next to the Hawk & Dove, also said Kennedy was spotted in the Hawk & Dove Wednesday.
Hawk & Dove manager Edgar Gutierrez said Kennedy is a regular in the bar. Gutierrez said he was working Wednesday night but did not see the congressman.
Kennedy, who has battled booze and drug problems in the past, said in his first statement: “I will fully cooperate with the Capitol Police in whatever investigation they choose to undertake.”
Despite the wreck, Kennedy took part in normal business at the Capitol yesterday and appeared unshaken by the incident as he chatted with other members. But one Rhode Island political insider said there has been talk of Kennedy’s bizarre behavior of late.
“He has looked terrible lately,” the source said. “He’s been acting goofy, kind of zany.”
In addition to seeking substance abuse treatment as a teen, Kennedy has acknowledged being diagnosed with bipolar disorder.
A spokeswoman for Kennedy’s father, U.S. Sen. Edward M. Kennedy, said the senior Massachusetts senator would have no comment on the matter.

I've got two friends that are captiol police officers and they've been gagged on discussing this incident along with the McKinney problem. I'm unsure if the whole department is "locked down" but they're pretty upset at recent problems.
Police chief is forced to resign, McKinney incident, now the Kennedy fiasco. The officers all loved the chief and it seems that upon his departure no one wants to make ripples in the capitol pond. These guys have a hard gig, protecting shit is not on their wish list.
I agree with TR, 30 days or less he'll be in rehab pulling some crybaby bleeding heart story as to why he's doing these stupid things. I'm sure that daddy will have a story to coincide with jr's problems. He'll probably say that he's ultimately to blame for not being there when his son needed him the most. Their clan is good at diverting attention away with feel good stories.

WASHINGTON — Rep. Patrick Kennedy will enter rehab for addiction to prescription pain medication evening after a highly publicized car crash near the Capitol, sources tell FOX News Friday.
The congressman was announcing his decision during a news conference Friday afternoon, then planned to travel to Minnesota later in the day.
But questions still remain over the treatment of the early Thursday incident.
Although the Rhode Island Democrat says he didn't ask for preferential treatment after he crashed his car into a barrier on Capitol Hill, barely missing a police patrol car, a police union official says that may not be the case.
Kennedy, who crashed his Ford Mustang early Thursday morning, has denied that he was under the influence of alcohol, and said he was taking prescriptions for nausea and sleeplessness, including the sleep-aid drug, Ambien.
"I never asked for any preferential treatment," Kennedy told reporters early Friday. Asked if he received any, he said: "That's up for the police to decide, and I'm going to cooperate fully with them."
According to a police report obtained by FOX News, an officer had to swerve out of the way to avoid being hit at 2:47 a.m. Thursday when a speeding green Ford Mustang with its lights off apparently lost control and hit a curb. The officer began to follow the car, which kept driving until it struck a construction barrier. The driver turned out to be Kennedy.
The officer described the congressman's eyes as red and watery, his speech was slightly slurred, and upon exiting the vehicle, his balance was unsure.
Kennedy then said he was "headed to the Capitol to make a vote," the officer wrote. The last vote had been held six hours earlier.
Kennedy was cited with failure to keep in proper lane, driving at an unreasonable speed, and failing to give full time and attention to operation of a vehicle, according to the report.
Louis P. Cannon, president of the Washington chapter of the Fraternal Order of Police, who was not on the scene, said the officers who responded to the accident were instructed by an official "above the rank of patrolman" to take Kennedy home and no sobriety tests were conducted at the scene.
The police report does not address those claims.
"Well, obviously, special consideration was given to him," Cannon told FOX News on Friday. "I mean, it may be deemed by some people to be preferential. I don't think, probably, you or I would have got the same the same type of treatment. ... He was certainly given some special consideration because of his position."
Cannon acknowledged, however, that there are special rules that allow for special treatment of congressional representatives who are on their way to a vote, which apparently was one of Kennedy's claims.
Cannon also said that while he had heard from officers that Kennedy has smelled of alcohol, he was not there, and had not seen the official report yet. He said, however, that from other visual signs Kennedy showed, officers could have followed up with a number of field sobriety tests.

Kennedy said in a statement that the attending physician for Congress on Tuesday had prescribed Phenergan to treat Kennedy for gastroenteritis, an inflammation of the stomach and intestines. Kennedy said he later found out it could cause drowsiness.
Kennedy said that after working Wednesday evening, he went home and took prescribed amounts of Phenergan and Ambien, which he said the congressional doctor also had prescribed, and which he takes occasionally.
"Some time around 2:45 a.m., I drove the few blocks to the Capitol Complex believing I needed to vote. Apparently, I was disoriented from the medication," Kennedy said in the statement. He said he had the accident, and, "at no time before the incident did I consume any alcohol."
The Boston Herald reported Friday that Kennedy had been seen at a Capitol Hill restaurant and bar, Hawk and Dove, in the hours before the collision.
"He was drinking a little bit," a hostess told the newspaper. The Herald also said a bartender from a nearby establishment also saw the congressman at Hawk and Dove.
A woman who answered the phone at the restaurant Friday said she could not confirm the reports that the congressman had been seen at the bar, but said there have been numerous press inquiries about the incident.
"We're trying to open a restaurant here," she told FOXNews.com.
A Kennedy spokeswoman said the congressman has received the official accident report from police at his Washington office and that he and his aides are reviewing it.
Kennedy spent time at a drug rehabilitation clinic years ago before he went to Providence College. He has been open about mental health issues, including being diagnosed with bipolar disorder. Sen. Edward Kennedy, D-Mass., is the congressman's father.
The elder Kennedy canceled two public events Friday, one at a Manhattan elementary school, and another at a book signing later in the day. The senator has said he will not comment on the incident.

The eight-seat Cessna Citation 550 plane lost all electrical power, including communications, and the pilot had to fly the plane manually, according to spokeswoman Melissa Wagoner. No one was hurt.
The Democrat had just delivered the commencement address at the Massachusetts College of Liberal Arts in North Adams and was on his way to his Cape Cod home when the plane was struck around 4 p.m., she said.
The jet landed safely at New Haven at 4:11 p.m., said Federal Aviation Administration spokeswoman Arlene Murray. A report was filed with the agency, which will look into the incident, she said.
Kennedy planned to stay in Connecticut overnight because he was scheduled to return to western Massachusetts on Sunday to deliver a commencement address at Springfield College, Wagoner said.

Such a softball here, but I'll exercise some restraint and hold on the off-color jokes here.
The sad thing is Pattsy will get re-elected here in RI. The sadder thing is a few months ago there was talk of Pattsy running for Senate. I worked on his opponent Dave Rogers' campaign last cycle. Rogers was a SEAL who saw duty in Panama, out-debated Pattsy, raised $1mil +, and was a family man (district is politicaly liberal, but socialy Catholic), yet was able to only score a few points more then the automatic 30% you get for running against a Democrat/Kennedy. Having the Kennedy last name is political gold. It really grinds my gears to think that this country was created inpart to give a one-fingure salute to aristocracy, only to embrace it 200 some years later (I do realize this issue transends partisan lines).

I suspect he returned to MA on Sunday because here in CT we have our Blue Law on the Sabbath.
